HomeMy WebLinkAboutORD NO 2774ORDINANCE NO. 2774 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE WEST SIDE OF GOSFORD ROAD, BETWEEN STOCKDALE HIGHWAY AND MING AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Rakersfield located on the West side of Gosford Road, between Stockdale Highway and Ming Avenue; and WHEREAS, the Planning Commission, as a result of said hearing, did make several genera] and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from A to R-2 and OS, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General ]Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Plannin,~ Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN A (AGRICULTURAL) ZONE TO AN R-2 (LIMITED MULTIPLE FAMILY DWELLING) ZONE AND TO AN OS (OPEN SPACE) ZONE: Those certain parcels of land in the East Half of Section 5, Township 30 South, Range 27 East, M.D.M., and the Southeast Quarter of Section 32, Township 29 South, Range 27 East, M.D.M., described as follows: Parcel 1 To be zoned R-2: Beginning at the Southeast corner of said Section 5, which point is the intersection of the centerline of Gosford Road and Ming Avenue; Thence along the centerline of said Ming Avenue, North 89009'52" West, 1,067.063 feet to the point of intersection with the East line of an easement granted to Pacific Gas and Electric Company by document recorded .July 16, 1962 in the Office of the Kern County Recorder in Book 3509 of Official Records at Page 883; Thence along the East line of said easement the following courses and distances: (1) North 01°41'11" East, 1,023.09 feet; Thence (2) North 00°44'11" East, 1,834.310 feet; Thence (3) North 02044'02" East, 2,447.067 feet, more or less, to a point on the South line of said Section 32; Thence continuing North 02044'02" East, 25.00 feet to the centerline of Stockdale Highway; Thence along said centerline, South 89°04'39" East, 940.365 feet, more or less, to a point on the East line of the Southeast Quarter of said Section 32 and the centerline of said Gosf©rd Road; Thence along the centerline of Gosford Road, South 00o40'05" West, 25.00 feet to the Northeast corner of said Section 5; Thence along the East ]i~ ~f i~he Northeast Quarter of Section 5, being the centerline of Gosford Road, South 00028'43" West, 2,641.846 feet to the East Ouarter corner of Section 5; Thence along the East line of the Southeast Quarter of Section 5, also being the center- line of Gcsford Road, South 00°29~07" West, 2,659.919 feet to the Southeast corner of Section 5 and the Point of Beginning. EXCLUDING THEREFROM the right-of-way of Stockdale Highway, Gosford Road and Ming Avenue. Containing 124.747 acres, more or less. Parcel 2 - To be zoned Open Space: Com- mencing at the Southeast corner of Section 5; Thence along the South line of Section 5, being also the centerline of Ming Avenue, North 89o09'52" West, 1,067.063 feet to the point of intersection with the East line of the said 65.00-foot easement granted to Pacific Gas and Electric Company by document recorded July 16, 1962, in the Office of the Kern County Recorder in Book 3509 of Official Records at Page 883, and the True Point of Beginning; Thence continuing along the South line of said Section 5, being the centerline of Ming Avenue, North 89°09'52" West, 215.62 feet to a point on the East right-of-way line of the Arvin-Edison Canal; Thence along said East right-of-way line, the following courses and distances: (1) North 01°45'24" East, 342.05 feet; Thence (2) South 88°4'36" East, 25.00 feet to the beginning of a non-tangent curve, concave to the West of radius of 1,085.00 feet; ~£hence (3) Northerly on and along said curve through a central angle of 05000'00", an are distance of 94.684 feet; Thence (4) North 03014'36" West, 199.518 feet to the beginning of a tangent curve, concave to the East of radius of 915.00 feet; Thence (5) Northerly on and along said curve through a central angle of 05o00'00", an arc distance of 79.849 feet; Thence (6) North 01045'24" East, 295.780 feet to the beginning of a tangent curve, concave to the West of radius of 1,085.00 feet; Thence (7) Northerly on and along said curve through a central angle of 01°10'30", an arc distance of 22.251 feet; Thence (8) North 00o34'54" East, 1,808o100 feet to the beginning of a tangent curve, concave to the East of radius of 915.00 feet; Thence (9) Northerly on and along said curve through a central angle of 02°15'00", an arc distance of 35.932 feet; Thence (10) North 02o49'54" East, 2,427,877 feet to a point on the South line of Section 32; Thence (11) North 02~9'54" East, 25.00 feet to the centerline of Stockdale Highway; Thence along said centerline, South 89°04'39" East, 215.173 feet to the Northerly pro- longation of the Easterly line of said easement granted to Pacific Gas and Electric Company; Thence South 02044'02" West, 25.00 feet to the North line of Section 5; Thence along the East line of said easement granted to Pacific Gas and Electric Company, the following courses and distances: (1) South 02044'02" West, 2,447.06 feet; (2) South 00°44'11" West, 1,834.41 feet; Thence (3) South 01°41'11" West, 1,023.087 feet to the South line of Section 5, being the centerline of said Ming Avenue and the True Point of Beginning. EXCEPTING THEREFROM the right-of-way of Ming Avenue and Stockdale Highway. Containing 26.398 acres, more or less.
