ROLL CALL: Present: Commissioners Lomas, Blockley, Johnson, McGinnis, Spencer, Tkac(arrived at 5:35 p.m), Tragish Advisory Members: Robert Sherfy, James D. Movius, Marian Shaw, Phil Burns Staff: Jim Eggert, Jennie Eng, Dana Cornelius, Robin Gessner 2. PLEDGE OF ALLEGIANCE: Commissioner Spencer advised Staff that he has reviewed and listened to the tape of the previous meeting two weeks ago. 3. PUBLIC STATEMENTS: None. 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items 4.1 a Approval of minutes for Planning Commission meeting of October 19, 2006. Commissioner Tragish requested revision of the October 19, 2006 Minutes on page 2, agenda item number 5, second paragraph indicating that it should read: "Commissioner Tragish commented that in the Executive Summary of the Draft EIR under long term esthetic impacts sections 5.5-2 and 5.5-3 it summarizes that any future development would result in significant and unavoidable long term esthetic impacts. He stated that the summary on page 5/5.5-13, notwithstanding its conclusions provided that the potential view impairments to the foothills are not considered to be significant as future site development will be guided by the applicable Metropolitan Bakersfield General Plan Policies, as well as implementation action as set forth in the Land Use and Open Space Elements. Commissioner Tragish stated that he would like to have some examples of how this is going to be implemented in its application to the Metropolitan Bakersfield General Plan and Land Use and Open Space Elements." Commissioner Tragish further requested revision of agenda item number 7.3 in the third paragraph from bottom of page 3, indicating it should read: "Commissioner Tragish stated he agrees with Commissioner Lomas, but stated that he is not sure that there are restrictions on our findings, and by law there may be some leeway to discuss the impact to the single family residents, however the developer has done his part to mitigate." Commissioner Blockley moved, seconded by Commissioner Tkac, to approve the non-public hearing consent calendar. • Items on this Agenda will be heard at 5:30 p.m. on Thursday, but not necessarily in the same order. Planning Commission - November 16, 2006 Page 2 Motion carried by group vote. 4.2 Public Hearing Items 4.2a APPROVAL OF MCCALLISTER RANCH WALL, MONUMENTATIN, AND LANDSCAPE CONCEPT PLAN FOR THE ENTRY STREETS (FILE#06-1705)Agenda Item 5 4.2b Approval of Vesting Tentative Tract Map 6868 (McIntosh &Associates) 4.2c Approval of Vesting Tentative Tract Map 6876(GSJ Company, LLC) 4.2d Approval of Vesting Tentative Tract Map 6894 (SmithTech/USA, Inc.) 4.2e Approval of Vesting Tentative Tract Map 6917 (Pinnacle Engineering) The public hearing is opened. No one requested removal of any consent item. The public hearing is closed. Commissioner McGinnis moved, seconded by Commissioner Blockley, to approve the public hearing consent calendar. Motion carried by the following roll call vote: AYES: Commissioners: Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish, Lomas. NOES: None 5. PUBLIC HEARING — McCALLISTER RANCH WALL, MONUMENTATION, AND LANDSCAPE CONCEPT PLAN FOR THE ENTRY STREETS (FILE#06-1705) Heard on Consent Calendar. 6. NON-PUBLIC HEARING — Vesting Tentative.Tract Map 6755 (Hendricks Engineering) (Continued from October 5, 2006, November 2, 2006 and Re-advertised) (Note: The public hearing for this item was closed on November 2, 2006) Staff report given. Commissioner McGinnis commended Staff and the applicant to arriving at a resolution. He stated that he can support this project. Commissioner Blockley inquired what the time frame is without having to re-file this and go through the entire process again. Staff responded that the map could have a life of eight years. Commissioner Blockley moved, seconded by Commissioner Johnson, to approve vesting tentative tract map 6755 with findings and conditions set forth in the attached Resolution, subject to changes as referred to in the November 16, 2006 memo from the Planning Department. Motion carried by the following roll call vote: AYES: Commissioners: Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish, Lomas. NOES:None 7. PUBLIC HEARINGS—Tentative Tract Map Vesting Tentative Tract Maps 7.1 Vesting Tentative Tract Map 6868 (McIntosh &Associates) Heard on Consent Calendar. Planning Commission - November 16, 2006 Page 3 7.2 Vesting Tentative Tract Map 6876 (GSJ Company, LLC) Heard on consent calendar. 7.3 Vesting Tentative Tract Map 6894 (SmithTech/USA) Heard on consent calendar. 7.4 Vesting Tentative Tract Map 6917 (Pinnacle Engineering) Heard on consent calendar. 8. COMMUNICATIONS: Planning Department Operations Update by Mr. Movius. Commissioner Johnson inquired what the foreseeable hurdles/problems are with the Hillside Ordinance implementation. Mr. Movius responded that timing is an issue with regard to grading requirements, and that they need some geotech expertise to look at the ordinances. He further commented that the same applies to drainage and MPDES requirements. Commissioner McGinnis thanked the Staff. Commissioner McGinnis further inquired as to the off-road parks to which Staff responded that it will not actually be annexed to the City, and that he can provide a cumulative project map that indicates the annexations. Commissioner Lomas inquired if the upcoming large projects would be depicted on the cumulative project map, to which Mr. Movius responded in the affirmative. Commissioner Spencer thanked the Staff for their report on the Westside Parkway. Commissioner Blockley thanked everyone on Staff and the Commission. 9. COMMISSION COMMENTS: 10.
