HomeMy WebLinkAboutORD NO 2768ORDINANCE NO. 2768 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING CHAPTER 15.32 OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO ELECTRICAL CODE. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Chapter 15.32 of the Municipal Code of the City of Bakersfield is hereby amended to read as follows: Chapter 15.32 ELECTRICAL CODE Sections: 15.32.010 15.32.020 15.32.030 15.32.040 15.32.050 15.32.060 15.32.070 15.32.080 15.32.090 15.32.100 15.32.110 15.32.120 15.32.130 15.32.140 15.32.150 15.32.160 15.32.170 Amendments to Section 104(c) Section 302(d) Section 303(d) Section 308(a) installations. Article 336-3 amended - Uses permitted or not permitted. Fee schedule. 15.32.010 Adoption of Uniform Electrical Code (Primary) and National Electrical Code (Secondary). Except as otherwise provided in this Chapter, that certain primary electrical code known and designated as the "Uniform Electrical Code," published by Pacific Coast Electrical Association, Inc., 1979, and that certain secondary electrical code known and designated as the "National Electrical Code, 1981 Edition," published and sponsored by the National Fire Protection Association, three (3) copies of both codes having heretofore been filed with the City Clerk of the City for use and examination by the public, are adopted as the electrical code of the City, and each provision and portion thereof, except as otherwise in this Chapter provided, is referred to and made a part of this Chapter to the same effect as if fully set forth in this Chapter. 15.12.020 Deletion of certain sections of Uniform Electrical Code. A. Sections 201(a), 204, 304, 311 and 312 of the Uniform Electrical Code are deleted and suspended by the applicable sections of Sections 15.04.030 through 15.04.170. 15.32.030 Amendments to Uniform Electrical Code. Sections 104(c), 302(d), 303(d) and 308(a) are amended as set forth in Sections 15.32.040 through 15.32.070. 15.32.040 Section 104(c) amended - Existing installations. Section 104(c) of the Uniform Electrical Code is amended to read as follows: (c) Existing Installations. Building electrical equipment and systems lawfully in existence at the time of the adoption of the 1981 National Electrical Code may have their use, maintenance or repair continued if the use, maintenance or repair is in accordance with the original design and no hazard to life, health or property has been created by such building service equipment. 15.32.050 Section 302(d) amended Permit applicant. Section 302(d) of the Uniform Electrical Code is amended to read as follows: (d) Applicant. An application for an electrical permit may be filed (made) by any one (1) of the following: 1. Qualified Installer. A qualified installer is a person, firm or corporation holding a valid Contractor's License to perform such work in this jurisdiction; or 2. Maintenance Electrician. In lieu of an individual permit for each i. nstallation or alteration, an annual permit may, upon application therefor, be issued to any person, firm or corporation regularly employing one (1) or more electricians for installation and maintenance of electrical wiring, devices, appliances, apparatus or equipment on premises owned or occupied by the applicant for the permit. The application for such annual permit shall be made in writlng to the Chief Electrical Inspector and shall contain a description of the premises within which work ~s to be done under the permit. Within not more than fifteen (15) days following the end of each calendar month, the person, firm or corporation to which an annual permit is issued shall transmit to the Chief Electrical Inspector a report of all electrical work which has been done under the annual permit during the preceding month; or 3. Home Owner. The Chief Electrical Inspector may issue to an individual a homeowner's permit authorizing said individual to install, alter, change or repair any electrical wiring, devices, appliances, apparatus or equipment in, on or about a single family dwelling of which said individual is owner and in which he resides or intends to reside, but not elsewhere, provided that electrical work authorized under any such homeowner's permit shall be done personally by the owner. 15.32.060 Section 303(d) amended - Permit expiration. Section 303(d) of the Uniform Electrical (lode is amended to read as follows: (d) Expiration. Every permit issued by the Building Official under the provisions of the National Electrical Code shall expire by limitation and become null and void if the building or work authorized by such permit is suspended or abandoned at any time after the work ~s commenced for a period of one hundred eighty (180) days. Before such work can be recommended, a new permit shall be first obtained so to do, and the fee therefor shall be one-half (1/2) the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work, and provided further that such suspension or abandonment has not exceeded one (1) year. Any permittee holding an unexpired permit may apply for an extension of the time within which he may commence work under that permit when he is unable to commence work within the time required. 15.32.070 Section 308(a) amended - Applicability to installations. Section 308(a) of the Uniform Electrical Code is amended to read as follows: (a) The requirements of the 1981 Edition of the National Electrical Code (470 Atlantic Avenue, Boston, MA 02210) shall apply to all installations. 15.32.080 Amendments to National Electrical Code, 1981 Edition. The following sections are added to, amended or deleted from the National Electrical Code, 1981 Edition: Articles 336-3, 210- 8(a)(1), 210-8(b), 230-57, 250-80, 250-81, 300-13(c) and 333 as set forth in Sections 15.32.090 through 15.32.16(}. 15.32.090 Article 210-8(a)(1) amended - Ground-fault circuit interruptor protection. Article 210-8(a) (1) of the National Electrical Code is amended to read as follows: All 125 voit 15 and 20 ampere receptacles installed in bath- rooms of dwelling units and in bathrooms of hotel rooms, motel rooms and similar occupancies shall have ground-fault circuit- interruptor protection for personnel. 15.32.100 Article 210-8(b) amended - Construction sites. Article 210-8(b) of the read as follows: Construction sites: National Electrical Code is amended to All 125 volt single phase 15 and 20 ampere receptacle outlets which are not part of the permanent wiring of a completed building or structure shall have ground- fault circuit-interrupters for personnel protection. 15.32.110 Section 230-57 added - Special residential requirements. Section 230 (Services) of the National Electrical Code is amended by adding the following article: 230-57 Special Residential Requirements. In residences, the service entrance conduit shall be rigid metallic conduit for overhead services. 15.32.120 Article 250-80 amended - Water pipe bonding. Article 250-80 is amended by adding the following exceptions: 1. In multi-occupancy buildings, a bonding jumper sized in accordance with Table 250-95 may be used to bond the water piping system to the feeder equipment grounding conductor where: (a) Each occupancy has an individual metallic water piping system; (b) The water service is non-metallic; and circuit panel board. 2. Article 300-13 of the National Electrical Code is amended by adding a new paragraph (c) as follows: (c) All grounding terminations shall be made-up, except for attachment to devices, prior to rough inspection. 15.32.150 Article 333 deleted - Armored cable. Article 333 of the National Electrical Code, 1981 Edition, is not adopted as part of the ordinance codified in this Chapter and is deleted. 15.32.160 Article 336-3 amended Uses permitted or not permitted. Article 336-3 of the National Electrical Code is amended to read as follows: Uses permitted or not permitted. Type NM and NMC cables shall be permitted to be used in one and two family dwellings or multi-family dwellings not exceeding three (3) floors above grade.
