HomeMy WebLinkAboutORD NO 2759ORDINANCE NO. 2759 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS 500 WEST COLUMBUS STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of certain property in the City of Bakersfield commonly known as 500 West Columbus Street; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from MH (Mobilehome) to C-1 (Limited Commercial) or more restrictive zone and to a C-2 (Commercial) or more restrictive zone, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said property, that a zoning change should be authorized, subject to the following condition: and Property owner shall install a six-foot high chain-link fence to City standards, along the east property line adjacent to the canal, within 180 days of adoption of this Ordinance or upon the start of construction, whichever is sooner. WHEREAS, pursuant to Section 17.08.190 C. of the Municipal Code of the City of Bakersfield, the owner of the property hereby rezoned has contracted to perform the condition re fencing along the canal set forth above and has tendered a registered check as a guarantee of performance of such contract, which registered check is for an amount deemed sufficient by the Public Works Department of the City of Bakersfield to cover the cost to the City of Bakersfield of having the contract performed by others should the property owner default thereon; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ©RDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property attached and made a part hereof, FROM AN MH (MOBILEHOME) are shown on the map hereto as follows: ZONE TO A C-1 (LIMITED COMMERCIAL) OR MORE RESTRICTIVE ZONE AND TO A C-2 (COMMERCIAL) OR MORE RESTRICTIVE ZONE: To a C-I Zone Beginning at the Northeast corner of Parcel 3 of amended Parcel Map 3512 recorded in Book 22 of Parcel Maps at Page 19 in the Kern County Recorder's Office; Thence North 20° 46'16" West, 104.83 feet; Thence South 89° 58'08" East, 192.99 feet to the Easterly line of Parcel 4 of said amended Parcel Map 3512; Thence along said Easterly line South 20°57'28" East, 104.96 feet; Thence North 89° 58'08" West, 193.36 feet to the Point of Beginning. Contains 0.43 acre. To a C-2 Zone Beginning at the Northwest corner of Parcel 3 of amended Parcel Map 3512 recorded in Book 22 of Parcel Maps at Page 19 in the Kern County Recorder's Office; Thence North 00° 01'44" East, 98.00 feet; Thence South 89° 58'08" East, 105.90 feet to the Easterly line of Parcel 2 of said amended Parcel Map 3512; Thence along said Easterly line South 20°46'16" East, 104.83 feet to the Northeast corner of Parcel 3; Thence along the North line of said Parcel 3 North 89058'08" West, 143.13 feet to the Point of Beginning. Contains 0.28 acre. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of Jts passage. ......... o0o .........
