ORDINANCE NO.
AN ORDINANCE ADDING SECTION 15.64.340
TO THE BAKERSFIELD MUNICIPAL CODE
RELATING TO THE CALIFORNIA FIRE CODE
(TEMPORARY MEMBRANE STRUCTURES, TENTS AND CANOPIES)
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1
Section 15.64.340 is hereby added to the Bakersfield Municipal Code to
read as follows:

Parking.
Section 3205.2 amended - Location and
SECTION 3205.2 Location and Parking of the California Fire Code is amended
to read as follows:
Tents shall not be located within 20 feet (6096 mm) of property lines, buildings,
temporary membrane structures, other tents and canopies, parked vehicles or
internal combustion engines. For the purpose of determining required distances,
support ropes and guywires shall be considered as part of the temporary
membrane structure, tent or canopy.
EXCEPTION: Separation distance between temporary membrane
structures, tents and canopies, not use for cooking, is not required when the
aggregate floor area does not exceed 15,000 square feet (1393.5m2).
EXCEPTION: Setback distances and separation distances for tents
located at residences, and used for personal activities, will be waived providing
that adequate spacing is provided for supports, ropes and guywires, as well as
adequate and safe access and egress from the tent. Tent owners and vendors
will be responsible for proper permits.
SECTION 2
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and
after the date of its passage.
