A RESOLUTION APPROVING AND ADOPTING AN
ADJUSTED FEE PURSUANT TO CHAPTER 15.78 OF
THE BAKERSFIELD MUNICIPAL CODE RELATED TO
THE METROPOLITAN BAKERSFIELD HABITAT
CONSERVATION PLAN MITIGATION PROGRAM.
WHEREAS, Chapter 15.78 of the Bakersfield Municipal Code establishes the implementation
of the Metropolitan Bakersfield Habitat Conservation Plan Mitigation Program; and
WHEREAS, the boundaries of the Metropolitan Bakersfield Habitat Conservation Plan
Mitigation Program are as shown in attached Exhibit "An; and
WHEREAS, Section 15.78.040 provides that the City Council establish the associated fees
by resolution; and
WHEREAS, on August 10, 2006, the Metropolitan Bakersfield Habitat Conservation Plan
Implementation Trust Group adopted a recommendation to the Bakersfield City Council and Kern
County Board of Supervisors to increase the Habitat Mitigation Fee from $1,240 per gross acre to
$2,145 per gross acre; and
WHEREAS, the proposed increase to the Habitat Mitigation Fee is necessary to maintain the
financial viability of the Metropolitan Bakersfield Habitat Conservation Plan through the end of the
program in year 2014; and
WHEREAS, the Kern County Board of Supervisors adopted the same increase in fee for
unincorporated areas within the Plan boundary on December 12, 2006; and
WHEREAS, the requirements of Section 66000 et.seq., of the California Government Code
have been satisfied; and
WHEREAS, the City Council at a regularly scheduled meeting of the City Council held
December 13, 2006, held a public hearing to receive public comment regarding the proposed
adjusted Habitat Mitigation fee; and
WHEREAS, the provisions of this resolution, shall supersede City Council Resolution
No.140-93; and
WHEREAS, the laws and regulations relating to CEQA and the City of Bakersfield's CEQA
Implementation Procedures, have been duly followed by city staff and the Planning Commission; and
WHEREAS, the above described project is Categorically Exempt from the requirements of
the California Environmental Quality Act in accordance with Section 15308 as an action by
regulatory agency for protection of the environment; and

WHEREAS, the Council has considered and hereby makes the following findings:
1. The above recitals and findings incorporated herein, are true and correct.
2. All required notices have been given.
3. The proposed adjustment in the fee amount is exempt from CEQA in accordance with
Section 15308.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield
as follows:
1. The Habitat Mitigation Fee referred to in Section 15.78.040. of the Bakersfield
Municipal Code is hereby adjusted and established to be Two Thousand One Hundred Forty-five
Dollars ($2,145.00) per gross acre.
2. The processing fee for a in-lieu application referred to in Section 15.78.060(C) ofthe
Bakersfield Municipal Code shall be Three Hundred Seven Dollars ($307.00) per application.
3. The amount of the Habitat Mitigation Fee referred to in Section 15.78.060(E) of the
Bakersfield Municipal Code attributable to the cost of fencing and the habitat management lands, the
cost of ensuring the management and enhancement of the habitat management lands and the
administrative costs attributable to the Metropolitan Bakersfield Habitat Conservation Plan Program,
which shall be paid by those transferring lands in-lieu of payment of the land acquisition portion of
the Habitat Mitigation Fee, shall be Five Hundred Twenty-nine Dollars ($529.00) per gross acres.
