HomeMy WebLinkAboutORD NO 2749ORDINANCE NO. 2749 NEW SERIES AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING CHAPTER 6.20 TO THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO MAIMIN(;, INJURING OR KILLING OF ANIMALS. WHEREAS, there is s trend to maim, injure or kill animals in public view in theatrical and musical performances; and WHEREAS, the public display of the maiming, injuring or killing of animals as entertainment ~.s not. conducive to the public health and welfare; and WHEREAS, Jt is necessary to adopt an emerqency ordinance to protect the p~iblic health and welfare from the above-described activity. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Chapter 6.20 ~s hereby added to the Municipal Code of the City of Bakersfield to read as follows: Chapter 6.20 MAIMING, INJURING OR KILLING OF ANIMALS Sections: 6.20.010 6.20.020 6.20.030 Use of Animals in Theatrical Performances. Violation - Penalty. [~everance Clause. or Musica] Use of Animals in Theatrical or Musical Performances. or including in the 6.20.010 No person shall knowingly, nor shall any device, machine contrivance be used to, maim,. injure or kill any animal, fowl, during any live theatrical or musical performance City of Bakersfield. 6.20.020 Violation - Penalty. Any person, firm or corporation violating any of the provisions of this Chapter shall be deemed guilty of a misd~meanor and, upon conviction thereof, shall be punished by a fine of not more than Five ~{undred Dollars ($500.00) or by imprisonment in the County Jail for a period not exceeding six (6) months, or by both such fine and imprisonment. 6.20.030 Severance Clause. If any section, sentence, clause or phrase of this ordinance ~s for any reason held to be uncon- stitutional, such decision shall not affect the validity of the remaining sections, or the ordinance as that this ordinance such section, sentences, clauses or phrases of th~s ordinance, an entirety, it being the legislative intent shall stand notwithstanding the invalidity of sentence, clause or t~hrase. SECTION 2. This ordinance is an emergency ordinance within the meaning of Section 24 of the City Charter and is to take effect upon passage by lhe City Council. ......... 000 ..........
