HomeMy WebLinkAboutORD NO 2744ORDINANCE NO. 2744 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE SOUTH SIDE OF TRUXTUN AVENUE, WEST OF MOHAWK STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property City of Bakersfield located on the South side of Truxtun West of Mohawk Street; and WHEREAS, the Planning Commission, as a result of in the Avenue, hearing, did make several general and specific findings of said fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-1 to C-O, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears environmental impact which could and to be no substantial detrimental result from the proposed project; WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined an(] found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO A C-O (COMMERCIAL AND PROFESSIONAL OFFICE) ZONE: That certain parcel of land in Sections 33 and 34, Township 29 South, Range 27 East, M.D.M., in the City of Bakersfield, Kern County, State of California, lying South of the South right-of-way line of Truxtun Avenue, North of the North right-of-way line of the Carrier Canal and West of the West right-of-way line of Mohawk Street and more particularly described as follows: Commencing at the Northwest corner of said Section 34; Thence along the West line of said Section, South 00025'07" East, 2,644.72 feet to a point on the South right-of-way line of Truxtun Avenue and the TRUE POINT OF BE- GINNING; Thence along the South right-of-way line of said Truxtun Avenue, North 69°08'01" East, 1,907.48 feet to the beginning of a tangent curve, concave Northwesterly, of radius of 5,040.00 feet, from which point the radial point of said curve bears North 20°52'01" West; Thence Northeasterly along said curve, throuqh a central angle of 10047'26", an arc distance of 949.18 feet to a point of re- verse curvature with a second curve, concave to the Southwest, of radius of 20.00 feet, from which point the radial point of said curve bears South 31039'27" East; Thence Southeasterly along said curve, through a central angle of 105015'54", an arc distance of 36.74 feet to a point on the West right-of-way line of Mohawk Street and a point of reverse curvature with a third curve, concave Northeasterly, of radius of 1,655.00 feet, from which point the radial point of said curve bears North 73036'27" East; Thence Southerly along said right-of-way line and curve, through a central angle of 08°44'16", an arc distance of 252.40 feet to the point of intersection with the North right-of-way line of the Carrier Canal; Thence Southwesterly on and along the said Northerly right-of-way of the Carrier Canal, the following courses and distances: (1) South 78°06 (2) South 68°50 (3) South 54°14 (4) South 60°06 (5) South 74°44 (6) South 78~29 (7) South 66°18 (8) South 60~14 more or less to said Section 34, 05" West 24" West 01" West 34" West 54" West 01" West 40" West 14" West 100 77 feet; 269 14 feet; 494 61 feet; 162 71 feet; 267 13 feet; 201 89 feet; 337 04 feet; 1,257.37 feet, a point on the West line of distant thereon South 00025'07" East, 2,968.26 feet from the Northwest corner of said Section 34; Thence continuing, (9) South 73045'52" West, 77.95 feet; (10) North 86032'54" West, (11) North 63027'22" West, (12) North 54~20'28" West, (13) North 69~54'17" West, Thence leaving said canal 98.60 feet; 76.53 feet; 269.40 feet; 122.04 feet; right-of-way line, North 13°55'01" West, 89.73 feet to a point on the South right-of-way line of said Truxtun Avenue and the beginning of a non- tangent curve, concave Northwesterly, of radius of 3,040.00 feet, from which point the radial point of said curve bears North 13°52'13" West; Thence Northeasterly along said curve and said South right-of-way line, through a central angle of 06058'47", an arc distance of 370.34 feet; Thence North 69°08'01" East, 256.79 feet to a point on the West line of said Section 34 and the True Point of Beginning. Containing 25.27 acres, more or less. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. ......... o0o .........
