AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 17.66.010 B.
AND 17.66.020 OF THE BAKERSFIELD MUNICIPAL
CODE RELATIVE TO CONDITIONAL USE PERMITS.
BE
as follows:
IT ORDAINED by the Council of the City of Bakersfield
SECTION 1.
Section 17.66.010 B. of the Bakersfield Municipal Code
is hereby amended to read as follows:
17.66.010 Scope - Procedure.
B. The procedures for filing applications, filing fees,
investigation, notices, public hearings, findings and appeals
shall be the same as provided in this Title for modifications,
except that public hearings may be waived on an application for a
conditional use permit for public utility or public service uses
or for public buildings when found to be necessary or appropriate
for the public health, safety, convenience or welfare.

in addition to reasonable conditions which may be imposed by the
Board of Zoning Adjustment, the permit shall also be subject to
all the conditions specified in subsection F. of Section 17.32.020.
B. The following uses may be permitted in any zone upon the
granting of a conditional use permit by the City Council, utilizing
the procedure set forth in Section 17.64.085:
1. Airports or aircraft landing fields.
2. Cemeteries, columbariums, crematories and mausoleums.
3. Establishments or enterprises designed or used for
large assemblages of people or automobiles, including amusement
parks, circuses, carnivals, expositions, fairgrounds, open-air
theaters, racetracks, recreational and sport centers.
4. Large scale neighborhood housing projects having a
minimum gross area of twenty (20) acres.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
