HomeMy WebLinkAboutORD NO 2735ORDINANCE NO. 2735 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE SOUTHEAST CORNER OF TRUXTUN AVENUE AND COFFEE ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield located on the Southeast corner of Truxtun Avenue and Coffee Road; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from A to C-l, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears environmental impact which could and to be no substantial detrimental result from the proposed project; WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN A (AGRICULTURAL) ZONE TO A C-1 (LIMITED COMMERCIAL) ZONE: PARCEL A Commencing at the West Quarter corner of Section 33, Township 29 South, Range 27 East, M.D.B.&M.; Thence South 00o38'57" West, on and along the West line of the Southwest Quarter of said Section 33, a distance 801.31 feet, to the West right-of-way line of the Arvin- Edison Canal; Thence North 39°22'16" East, on and along the West right-of-way line of the Arvin- Edison Canal, a distance of 79.93 feet to the East right-of-way line of Coffee Road and the True Point of Beginning; Thence North 00038'57" East, on and along the East right-of-way line of Coffee Road, a distar~ce of 98.18 feet, to the beginning of a tan~jent curve, concave to the East, having a radius of 1,950.00 feet; Thence Northerly, on and along said curve, throu~]h a central angle of 12°47'27", an arc distance of 435.32 feet; Thence North 13026'24" East, 280.00 feet, to the beginning of a tangent curve, concaw~ to the Northwest, having a radius of 2,050.00 feet; Thence Northeasterly, on and along said curve, through a central angle of 00°24'32", an arc distance of 14.63 feet, to a point of reverse curvature with a second curve having a radius of 20.00 feet, from which point the radial point of said curve bears North 76058'08" West; Thenc~ Northerly, on and along said curve, throuqh a central angle of 75045'28", an arc distance of 26.44 feet, to a point of reverse curvature with a third curve, having a radius of 2,040.00 feet, from which point the radial point of said curve bears North 01°12'40" West; Thence Easterly, on and along said curve, through a central angle of 09°19'21", an arc distance of 331.92 feet; Thence South 15046'53" West, 324.67 feet, to the beginning of a tangent curve, concave Northwesterly, having a radius of 650.00 feet; Thence Southeasterly, on and along said curve, through a central angle of 23035'23", an arc distance of 267.62 feet; Thence South 39°22'16" West, 410.48 feet, to the East right-of-way line of Coffee Road and the True Point of Beginning. Containing 4.71 Acres. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage.
