HomeMy WebLinkAboutORD NO 2732EMERGENCY ORDINANCE NO. 2732 NEW SERIES AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 16.28.170 A. OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO MINIMUM AVERAGE WIDTHS AND AVERAGE AREAS OF LOTS. WHEREAS, on March 31, 1982, this Council passed ordinances amending Title 17 of the Bakersfield Municipal Code and reducing the minimum lot area in R-I, R-S, R-2, R-3 and R-4 Zones from 7200 square feet to 6000 square feet, which ordinances shall take effect on May 2, 1982; and WHEREAS, Section 16.28.170 A. of the Bakersfield Municipal Code specifies an average minimum lot size of 7200 square feet per lot, conflicting thereby with those ordinances referred to above; and WHEREAS, unless this ordinance is adopted as an Emergency Ordinance, as of May 1, 1982, Section 16.28.170 A. shall be in conflict with the provisions of Title 17 of this Code, and application of the requirements of Section 17.28.170 A. to subdivisions meeting the requirements of Title 17 will result in unnecessarily large and expensive lots WHEREAS, based and determines that this in such subdivisions; and upon the foregoing, this Council finds Emergency Ordinance is necessary for the preservation of property and the efficient operation of the City's Planning and Public Works Departments. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 16.28.170 Aoof the Bakersfield Municipal Code is hereby amended to read as follows: 16.28.170 Lots. A. Lot Sizes. All residential lots shall have a minimum average width of sixty feet and an average area of six thousand square feet. If in the opinion of the commission lots of lesser area or lesser width will not be detrimental to the public welfare or injurious to the property or improvements of the other owners of property, the commission may vary said requirements and, in harmony with the general purpose and intent of this title, may approve lots of lesser area and lesser width. SECTION 2. This Ordinance is an Emergency Ordinance within the meaning of Section 24 of the City Charter and is to take effect upon passage by the City Council. ......... o0o .........
