AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING CHAPTER 17.40 OF THE
BAKERSFIELD MUNICIPAL CODE BY ADDING SECTION
17.40.040 RELATIVE TO D (ARCHITECTURAL DESIGN)
ZONE (LIMITATION OF APPLICATION AND CO-
ORDINATION WITH SITE PLAN REVIEW).
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 17.40.040 is hereby added to Chapter 17.40 of
the Bakersfield Municipal Code to read as follows:
17.40.040 Limitation of Application and Coordination with
Site Plan Review. From and after the effective date of the
ordinance adopting Chapter 17.53 of this Code, the zoning provided
for in this Chapter shall not be newly applied to property in the
City. Thereafter, modification of buildings, structures, signs
and landscaping on property previously zoned pursuant to this
Chapter shall be deemed to be made in conformance with all requirements
of this Chapter, if such modifications are made in conformance
with the requirements of Chapter 17.53 of this Code. Plans
approved by the Planning Commission prior to the effective date
of this ordinance shall expire twelve (12) months from such
effective date, unless a Building Permit has been issued therefor,
and future construction and development on such property shall
thereafter be subject to the procedures and requirements of
Chapter 17.53.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
