AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE 17 OF THE BAKERSFIELD
MUNICIPAL CODE BY ADDING CHAPTER 17.37 RELATIVE
TO AND ESTABLISHING OS (OPEN SPACE) ZONE.

Chapter 17.37 is hereby added to Title
Municipal Code to read as follows:

17.37.010 OS (Open Space) Zone. The following regulations shall
apply in the OS (Open Space) Zone unless otherwise provided.
17.37.020 Purpose. The purpose of the OS (Open Space) Zone is
to provide for permanent open spaces and recreational uses and to
safeguard the health, safety and welfare of the people by limiting
developments in areas where protection from unstable soils, flood-
ing, seismic activity or other special circumstances is required.
17.37.030 Uses Permitted. The following uses are permitted in
the OS Zone:
A. Agricultural use.
B. Parks for passive recreational use.
C. Wildlife preserves.
D. Riding and hiking trails.

Subject to the prohibitions of Section 17.37.060, the following
uses may be permitted, subject to a Conditional Use Permit, in accord-
ance with the procedures provided for in Chapter 17.64 and 17.66 of
this Title:
A. Single family residential uses not to exceed one (1) dwelling
unit per two (2) acres.
Public and private campgrounds and recreational vehicle
parks.

Public utility structures.
Archery ranges.
Equestrian facilities.
Golf courses and driving ranges.
Gun clubs or shooting ranges.
Racetracks, automotive, cycle or equine.
Baseball batting ranges.
Wholesale nurseries.
The Conditional Use Permit shall be granted only if it is
found that any building, structure or use to be constructed, placed
or maintained w~11 be so constructed, placed or maintained or will
be so protected that it will either be resistant or immune to
extensive damage by flooding, seismic activity or soil instability.
17.37.060 Building Height, Front Yard, Side Yard, Rear Yard,
Minimum Lot Area, Distance Between Buildings on the Same Lot.
No fixed restrictions shall apply to these criteria;
each shall be set by the approving authority under the provisions
of Chapter 17.53 for each proposed use location to avoid detriment
to adjacent property land usage.
SECTION 2.
This ordinance shall be posted in accordance with the City
Charter provisions and shall become effective thirty (30) days from
and after the date of its passage.
