A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD EXPANDING THE LIST OF CHARGES TO BE
HANDLED VIA THE COMMUNITY PROSECUTOR PROGRAM.
WHEREAS, on January 25, 2006, the City Council directed the City
Attorney to implement a Community Prosecution Program as an element of the
City Attorney's Office; and
WHEREAS, the program dedicates personnel to prosecute "quality of life"
crimes occurring in the City of Bakersfield; and
WHEREAS, those crimes consist of: all municipal code violations,
vandalism, resisting arrest, petty theft, possession of alcohol by minors; battery,
contributing to the delinquency of a minor, lewd act in public, disturbing the
peace, trespass, prostitution, drunk in public, etc.;
WHEREAS, at a mid-program review, the police department asked that
the community prosecutors begin to handle two misdemeanor gun-related
charges -- Penal Code section 12025 (carrying a concealed firearm) and Penal
Code section 12031 (carrying a loaded firearm in public); and
WHEREAS, the Legislative and Litigation Committee requested that the
full Council grant the City Attorney's office the authority to prosecute those
additional charges.
NOW, THEREFORE BE IT RESOLVED, by the Bakersfield City Council
that:
1 . The above recitals are true and correct; and
2. The City Attorney's office can add Penal Code sections 12025 and
12031 to the list of crimes handled by the Community Prosecution program.
