HomeMy WebLinkAboutORD NO 2704ORDINANCE NO. 2704 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING CHAPTER 17.22 OF THE BAKERSFIELD MUNICIPAL CODE BY AMENDING SECTIONS 17.22.020, 17.22.030 AND 17.22.040 AND ADDING SECTION 17.22.035 RELATIVE TO C-1 ZONE. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Subsections B and C of Section 17.22.020 of the Bakersfield Municipal Code are hereby amended to read as follows: 17.22.020 Uses Permitted. B. Automobile parking areas when developed as required in Section 17.34.020 if adjacent to a residential zone; Automobile seat cover and seat belt shops; Automobile service stations; Bakeries, employing not more than five (5) persons on premises; Banks; Barbershops; Beauty shops; Bookstores; Confectionery stores; Dressmaking or millinery shops; Drugstores; Dry cleaning, pressing and laundry agencies; Dry goods or notions stores; Electric appliance stores and repairs; }~1orist shops; Grocery, fruit and vegetable stores; Hardware stores; Hotels; Ice cream parlors; Ice storage houses of not more than five-ton capacity; Jewelry stores; Liquor stores; Meat markets or delicatessen stores; offices, business or professional; I~hotographic shops; l'rinting shops conducted primarily on a "while- you-wait" basis; Restaurants, tea rooms or cafes where all customers are served at a table or counter (excluding dancing, entertainment and sale of intoxicating liquors); Shoe stores or shoe repair shops; Stationery stores; Tailor, clothing or wearing apparel shops; Temporary offices, including portable, modular of prefabricated structures constructed in conformance with uniform code adopted by the City of Bakersfield (Title 15 of the Bakersfield Municipal Code) and not attached to permanent foundations may be allowed for a period not to exceed two (2) years, plus one (1) year extension subject to the approval of the Planning Commission. C. The above specified stores, shops or businesses shall be retail establishments selling new merchandise exclusively, except used merchandise clearly incidental to the regular business conducted on the premises, and shall be permitted only under the following conditions: 1. Such stores, shops or businesses, except automobile service stations, shall be conducted entirely within .~n enclosed building; 2. Products made incidental to a permitted use shall be sold at retail on the premises; 3. All public entrances to such stores, shops or businesses shall be from the principal street upon which the property abuts or within one hundred (100) feet thereof, except that @ rear or side entrance from the building to a public parking area [nay be provided; 4. The accessory buildings or structures necessary to such use located on the same lot or parcel of land, including a storage garage for the exclusive use of the patrons and employees of the above stores or businesses. SECTION 2. Section 17.22.030 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.22.030 Uses Permitted Subject to Conditional Use Permit. The following uses may be permitted, subject to a Conditional Use Permit, in accordance with the procedures provided for in Chapters 17.64 and 17.66 of this Title: Ambulance and other emergency medical service facilities; Antique shops: sale of antique household furniture, antique bric-a-brac, curios and objects d'art, wholly within a building. Sale of second-hand furniture, wares or merchandise is prohibited. I. J. K. L. R. S. T. Automobile custom sunroof and "T-top" sales and installation, when done entirely within a building and excluding engine or other mechanical repair work; Automobile tune-up specialty shops providing electrical and carburetor tune-up services and related work, when not done as a part of, or incidental to, the operation of an automobile service station, excluding heavy or major mechanical work such as would require removing the cylinder head or transmission, and excluding all body repair or paint work; Car washes, automatic or coin-operated - five (5) bay maximum; Carpet, awning, blinds, mattress or upholstery shops, including cleaning and repair, wholly within a building; Cleaning and pressing establishments using nonin- flammable and nonexplosive cleaning fluids; Drive-in, walk-up and take-out restaurants; Furniture stores; Health studios; New and used automobile sales lots; Nurseries (flowers and plants); Pet shops and small animal veterinary day clinics, wholly within a building; Radio and television stores; Refrigerated lockers; Restaurants, including the sale of alcoholic beverages when served together with and incidental to the serving of food or in a cocktail lounge as an accessory use to the restaurant; Retail automobile parts; Schools of dancing or musical instruction; Sporting goods stores; Undertaking establishments, mortuaries and funeral parlors. Video game arcades, where such games are primary business conducted on premises. SECTION 3. Section 17.22.040 of Chapter 17.22 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.22.040 Building Height. Building height shall be four (4) stories and not exceed sixty-five (65) feet. SECTION 4. Chapter 17.22 of the Bakersfield hereby amended by addin~ Section 17.22.035 17.22.035 Site Plan Review. All permitted uses pursuant to this Chapter shall be subject review as provided in Chapter 17.53. Municipal Code is to read as follows: and conditional to site plan SECTION 5.
