HomeMy WebLinkAboutORD NO 2699ORDINANCE NO. 2699 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING CHAPTER 1'7.14 OF THE BAKERSFIELD MUNICIPAL CODE BY ADDING SECTION 17.14.026 AND AMENDING SECTIONS 17.14.040 AND 17.14.070 RELATIVE TO R-2 ZONE. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 17.14.026 is hereby added to Chapter 17.14 of the Bakersfield Municipal Code to read as follows: 17.14.026 Site Plan Review. All permitted and conditional uses pursuant to this Chapter shall be subject to site plan review as provided in Chapter 17.53. SECTION 2. Section 17.14.040 of Chapter 1'7.14 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.14.040 Front Yard. The front yard setback is determined by intersection of the first or each successive story with a forty- one degree (41°) airspace diagonal as defined in Section 17.04.035. Roofs, parapets and appurtenances may not extend more than ten (10) feet beyond the air space diagonal. In determining front yard setback, except as provided in Section 1'7.08.125, no building shall be located closer than fifteen (15) feet to the front lot line. SECTION 3. Section 17.14.070 of Chapter 1'7.14 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.14.070 Minimum Lot Area. A. The minimum lot area shall be ]not less than six thousand (6,000) square feet, and the minimum lot area shall be not less than twenty-five hundred (2,500) square feet per dwelling unit. When a non-conforming lot has less than :six thousand (6,000) square feet and was recorded in the office of the County Recorder at the time of the passage of this Section, said lot may be occupied by not more than one (1) dwelling unit for each twenty- five hundred (2,500) square feet. B. Where there is an alley to the rear of the lot, the minimum lot area shall be measured to the center of said alley. C. A lot may be less than the minimum provided it is a lot shown on a recorded subdivision map approved by the City of Bakersfield. SECTION 4. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
