HomeMy WebLinkAboutORD NO 2698ORDINANCE NO. 2698 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING CHAPTER 17.12 OF THE BAKERSFIELD MUNICIPAL CODE BY AMENDING SECTIONS 17.12.010 AND 17.12.030 AND ADDING SECTIONS 17.12.015, 17.12.016, 17.12.040 AND 17.12.050 RELATIVE TO R-S, R-S-1A, R-S-2.5A, R-S-5A AND R-S-10A ZONES. BE as follows: IT ORDAINED by the Council of the City of Bakersfield SECTION 1. Section 17.12.010 of Chapter 17.12 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.12.010 R-S (Residential Suburban) Zone. A. All permitted uses and regulations in the R-S (Residential Suburban) Zone shall be the same as the R-1 Zone, except that the following additional uses are permitted: 1. Breeding, hatching, raising and fattening of poultry, fowl, birds, rabbits, fish and frogs for domestic use, provided that such fowl and animals shall be limited in number to one (1) per three thousand (3,000) square feet of lot area for turkeys, and one (1) per one thousand (1,000) square feet for all other animals with a maximum of twelve (12) turkeys, other fowl and animals. 2. Keeping of bovine animals, horses, burros, mules, sheep and qoats in a ratio not exceeding one (1) adult animal of the foregoinq for each one-half (1/2) acre of lot area. B. The keeping of such fowl and animals shall conform to all other provisions of law governing same, and no fowl[ or animals, nor any pen, coop, stable, barn or corral shall be kept or main- tained within fifty (50) feet of any dwelling or other building used for human habitation, or within one hundred (100) feet of the front lot line of the lot upon which it is located or within ten (10) feet of the street side of a corner lot, or within one hundred (100) feet of any public park, school, hospital, or similar institution. C. There shall be no raising, killing, or dressing of any such animals or poultry for commercial purposes. SECTION 2. Section 17.12.030 of Chapter 17.12 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.12.030 R-S-2.5A (Residential Suburban Two-and-One-Half- Acre Minimum Lot Size) Zone. A. Uses Permitted. All permitted uses and regulations in the R-S-2.5A (Residential Suburban Two-and-One-Half-Acre Minimum Lot Size) Zone shall be the same as the R-i, R-S and R-S-1A Zones, except that the minimum lot size shall not be less than two and one-half (2-1/2) acres. B. Uses Permitted Subject to Planning Director Review and Approval. The following uses may be permitted subject to review and approval by the Planning Director: 1. Nurseries and greenhouses, but not including any salesrooms or other buildings used for the sales of the products produced; 2. Public utility or public service buildings, structures and uses; 3. Public and private parks, playgrounds, golf courses and accessory buildings or structures necessary to such uses; 4. Temporary recreational uses (not to exceed sixty (60) calendar days in any twelve-month period); 5. Directional signs not to exceed six (6) square feet in area. C. Uses Permitted Subject to Conditional Use Permit. The following uses may be permitted subject to a Conditional Use Permit in accordance with the procedures provided for in Chapters 17.64 and 17.66 of this Title: 1. Commercial stables; 2. Permanent recreational facilities; 3. Sand and gravel removal from river; 4. Home occupations as defined in Section ]7.04.330 of this Title, provided that the provisions of subsection (3) of such section shall not apply to home occupations in this zone and that notwithstanding the provisions of subsection (9) of such section, persons hired or retained by the permittee and business associates of the permittee may enter the premises for purposes of loading, unloading and transferring materials or equipment. SECTION 3. Section 17.12.015 is hereby added to Chapter 17.12 of the Bakersfield Municipal Code to read as follows: 17.12.015 Minimum Lot Area. The minimum lot area shall not be less than twenty-four thousand (24,000) square feet; provided, however, that a lot of less area than herein required shall be permitted if a description of said lot was recorded as a separate lot in the office of the County Recorder prior to the time of the enactment of this Section. SECTION 4. Section 17.12.016 is hereby added to Chapter 17.12 of the Bakersfield Municipal Code to read as follows: 17.12.016 Minimum Lot Frontage. The minimum lot frontage shall be not less than eighty (80) feet on a standard street or forty (40) feet on a cul-de-sac or flag lot; provided, however, that a lot with less frontage than herein required shall be permitted if a description of said lot was recorded as a separate lot in the office of the County Recorder prior to the time of the enactment of this ordinance. SECTION 5. Section 17.12.040 is hereby added to Chapter 17.12 of the Bakersfield ~unicipal Code to read as follows: 17.12.040 R-S-5A (Residential Suburban Five Acre Minimum Lot Size Zone. All permitted uses and regulations in the R-S-5A (Residential Suburban Five Acre Minimum Lot Size) Zone shall be the same as for the R-S-2.5A Zone, except that the minimum lot size shall not be less than five (5) acres. Uses permitted in the R-S-2.5A Zone subject to Planning Director review and approval or Conditional Use Permit are similarly permitted in this Zone. SECTION 6. Section ]7.12.050 is hereby added to Chapter 17.12 of the Bakersfield Municipal Code to read as follows: 17.12.050 R-S-10A (Residential Suburban Ten Acre Minimum Lot Size) Zone. All permitted uses and regulations in the R-S-10A (Residential Suburban Ten Acre Minimum Lot Size) Zone shall be the same as for the R-S-2.5A Zone, except that the minimum lot size shall not be less than ten (10) acres. Uses permitted in the R-S-2.5A Zone subject to Planning Director review and approval or Conditional Use Permit are similarly permitted in this Zone. SECTION 7. This ordinance shall be posted City Charter provisions and shall become days in accordance with the effective thirty (30) from and after the date of its passage. ......... o0o .........
