HomeMy WebLinkAboutORD NO 2692ORDINANCE NO. 2692 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY ZONING THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED EAST OF MANOR STREET, BETWEEN THE KERN RIVER AND DENISE AVENUE ON THE SOUTH. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on action initiated by the Commission to zone those certain properties in the City of Bakersfield located East of Manor Street, between the Kern River and Denise Avenue on the South; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and zoning of the subject properties to FP-P, FP-S, R-S-2-1/ 2A-FP-S and R-S-2-1/2A-CH-FP-S, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for the zoning of said properties, that such zoning should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by establishing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: TO AN FP-P (FLOODPLAIN-PRIMARY) ZONE, TO AN FP-S (FLOODPLAIN-SECONDARY) ZONE, TO AN R-S-2-1/2A-FP-S (RESIDENTIAL SUBURBAN TWO- AND-ONE-HALF-ACRE MINIMUM LOT SIZE FLOOD PLAIN-SECONDARY) ZONE, AND TO AN R-S-2-1/2A-CH-FP-S (RESIDENTIAL SUBURBAN TWO-AND-ONE-HALF-ACRE MINIMUM LOT SIZE CHURCH FLOODPLAIN-SECONDARY) ZONE: Parcel A: All zoning designations being a portion of Parcel A being described as follows: A parcel of land situate in the City of Bakersfield, County of Kern, State of Cali- fornia, and being a portion of Sections 8, ].7, and 18, Township 29 South, Range 28 East, M.D.M., and being more particularly described as follows: Commencing at the Southwest corner of the Northwest Quarter of the Northeast Quarter of said Section 18; Thence along the West line of said Northeast Quarter, North 01°40'22" West, 306.36 feet to a point on a non-tangent curve concave to the Southwest, having a radius of 500 feet, from which point the radial of said curve bears South 32°12'46" West; Thence Southeasterly along said curve~ through a central angle of 18028'49", an arc length of 161.27 feet; Thence South 39018'25" East, 400 feet to the True Point of Beginning; THENCE (1) Northeasterly in a direct line 920 feet, more or less, to intersect the West line of the East 190 feet of the East Half of the Northwest Quarter of the North- east Quarter of said Section 18 with the North line of the South 320 feet of North- west Quarter of said Northeast Quarter; THENCE (2) Northeasterly, in a direct line, 770 feet, more or less, to intersect the East line of the West 280 feet of the Northeast Quart~r of the Northeast Quarter of said Section 18 with the South line of the North 460 feet of the last named Section; THENCE (3) Northeasterly, in a direct line, 560 feet, more or less, to intersect the West line of the East 570 feet of said Northeast Quarter of said Section 18 with the South line of the North 270 feet of said Section; THENCE (4) Northeasterly, in a direct line, 1,900 feet, more or less, to intersect the East line of the Southwest Quarter of the Southwest Quarter of said Section 8 with the North line of the South 35 feet of last named Section; THENCE (5) Northeasterly, in a direct line, 890 feet, more or less, to intersect the West line of the East 470 feet of said Southwest Quarter of said Section 8 with the North line of the South 100 feet of last named Section; THENCE (6) Northeasterly, in a direct line, 1,280 feet, more or less, to intersect the East line of the West 740 feet of the South- east Quarter of said Section 8 with the North line of the South 520 feet of last named Section; THENCE (7) Southeasterly, in a direct line, 1,020 feet, more or less, to intersect the West line of the East 1,020 feet of said Section 8 with the North 50 feet of said Section; THENCE (8) Northeasterly 1,100 feet, more or less, intersection of the East Section 8 with the North 580 feet of said Section, line of the South , in a direct line, to the point of line of said line of the South said point of intersection being in the exterior Corporate Boundary of the City of Bakersfield, said Corporate Boundary as delineated as of January 1, 1978; THENCE (9) Southerly and Westerly along various courses of the last named Corporate Boundary, to the True Point of Beginning. AREA #1 - To R-S-2-1/2A-CH-FP-S All that area within said Parcel "A" being more particularly described as follows: Parcel 1 and Parcel 4 of Parcel Map 2564 recorded February 19, 1975 in Book 12, Page 187, Office of the Kern County Re- corder; and Parcel "C" of Parcel Map 3862 recorded September 16, 1977 in Book 19, Page 39, Office of the Kern County Recorder. AREA #2 - To R-S-2-1/2A-FP-S All that area within said Parcel "A" de- lineated as Floodplain Secondary Zone on a map entitled "City of Bakersfield Kern River Floodway" and being prepared in September 1979 by Stetson Engineering, Inc., said map being on record at the City of Bakersfield Planning Department in the County of Kern, State of California. EXCEPTING THEREFROM: Area #1. That area shown as ALSO EXCEPTING THEREFROM: That portion lying in the Southeast Quarter of Section 8 and the Northeast Quarter of Section 17, Township 29 South, Range 28 East, M.D.B.&M. AREA #3 To FP-P All that area within said Parcel "A" de- lineated as Floodplain Primary Zone on a map entitled "City of Bakersfield Kern River Floodway" and being prepared in September 1979 by Stetson Engineering, Inc., said map being on record at the City of Bakersfield Planning Department in the County of Kern, State of California. AREA #4 - To FP-S All that area within said Parcel "A" de- lineated as Floodplain Secondary Zone on a map entitled "City of Bakersfield Kern River Floodway" and being prepared in September 1979 by Stetson Engineering, Inc., said map being on record at the City of Bakersfield Planning Department in the County of Kern, State of California. EXCEPTING THEREFROM: That area shown as Area #1 and Area #2.
