HomeMy WebLinkAboutORD NO 2683ORDINANCE NO. 2683 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED WITHIN THE RIO BRAVO GOLF COURSE AND SUR- ROUNDING PROPERTIES WITHIN SECTION 14, TOWN- SHIP 29 SOUTH, RANGE 29 EAST, M.D.M WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield located within the Rio Bravo Golf Course and surrounding properties within Section 14, Township 29 South, Range 29 East, M.D.M.; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from A to R-l, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said properties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN A (AGRICULTURAL) ZONE TO AN R-1 (ONE FAMILY DWELLING) ZONE: A portion of Section 14, Township 29 South, Range 29 East, Mount Diablo Meridian, being in the City of Bakersfield, County of Kern, State of California, more particularly de- scribed as follows: Commencing at the Southeast corner of said Section 14; Thence North 89°49'10" West along the South line of said section, 5,259.76 feet to the Southwest corner of said section; Thence North 00003'20" East along the West line of said section, 3,213.86 feet; Thence South 89056'40" East, 45.00 feet to the Southwest corner of Parcel Map 6317, filed for record in the Office of the County Recorder of said county in Book 27 of Parcel Maps at Page 16; Thence North 88017'00" East along the boundary of said parcel map, 520.32 feet; Thence continuing along said boundary, North 10°47'15" East, 820.38 feet; Thence North 49020'39" East along said boundary, 473.53 feet; Thence North 60048'00" East continuing along said boundary, 200.00 feet; Thence continuing along said boundary, North 06000'30" West, 356.48 feet; Thence North 85054'00" East along said boundary, 316.13 feet; Thence North 36020'56" East continuing along said boundary, 307.08 feet to a point on a curve, concave to the East, the center of which bears North 36~20'56" East a radial distance of 37.50 feet; Thence Northeasterly along said curve through a central angle of 155050'34" an arc length of 102.05 feet to a point on the boundary of said parcel map; Thence leaving said boundary and continuing along said curve through a central angle of 74053'46" an arc length of 49.02 feet to a point of reverse curvature, said curve having a radius of 25.00 feet; Thence Southeast along said curve through a central angle of 49°00'16" an arc length of 21.38 feet; Thence South 51°55'00" East, 279.92 feet to the beginning of a tangent curve, concave to the Northeast with a radius of 784.00 feet; Thence Southeast along said curve through a central angle of 178.07 Thence Thence Thence Thence Thence Thence Thence Thence Thence Thence 13°06 feet; South 65°01'45" North 51~54 51" South 81~02 03" South 42~04 00" South 30~42 00" South 64~02 00" South 50055 00" South 54°17 56" South 50~29 10" South 41°23 00" '45" an arc length of East, East East East East East East East East East line to a point on the West Thence South 00°06'19" West along said West line, 2,309.94 feet to the point of beginning. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. ......... o0o .........
