AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 2.52.120,
2.52.130 AND 2.52.150 REI~kTIVE TO THE CIVIC
AUDITORIUM.
BE IT ORDAINED by the Council of the City
as follows:

Bakersfield
SECTION 1.
2.52.120 of the Municipal Code of the City of
Bakersfield is hereby amended to read as follows:
2.52.120 Noncommercial Rental Rates. The Manager may grant
permission to use the Auditorium for strictly patriotic, charitable,
religious or civic purposes when sponsored by a recognized local
noncommercial organization at which an admission is charged,
collection taken, space or merchandise sold or revenue derived
directly or indirectly, at a rental of ninety percent (90%) of
the commercial rental rate established. To comply with this
regulation, a certificate of tax exemption must be supplied by
the federal government.
SECTION 2.
Section 2.52.130 of the Municipal Code of the City of
Bakersfield is hereby amended to read as follows:
2.52.130 Rental Rates When No Admission Charged. When no
admission is charged, no collection taken, no space or merchandise
sold and no revenue of any character derived, either directly or
indirectly, the Manager may grant permission for the use of the
Auditorium at a rental of eighty percent (80%) of the Basic
Rental Rates established. Failure to qualify under this section
by charging admission or taking a collection, whether within or
away from the Auditorium premises, shall result in the charge of
regular commercial rates.
SECTION 3.
Section 2.52.150 of the Municipal Code of the City of
Bakersfield is hereby amended to read as follows:
2.52.150 Rental by Schools. The Manager may grant permission
to use the Auditorium, or any part or facility thereof, to any
Public School District or to any parochial school of similar
educational standards, at a rental to be determined by the Manager,
but in any event not less than eighty percent (80%) of the rentals
provided in the schedule of basic rentals. Any such use of the
Auditorium shall be subject to the following terms and conditions:
(1) In the case of an application for the use of the
Auditorium by a public school, the application must be approved
in writing by an authorized official of the school upon order of
the Board of Education of the school district making the applica-
tion. If the application is made by a parochial school, the
application must be approved in writing by the executive head
thereof, or by some other authorized officer upon the order of
the controlling board thereof.
(2) The event or attraction must be a regular school
function or a recognized extra-curricular activity sponsored
directly by the school itself and not by any outside agency.
(3) The same rates as are charged other persons or
organizations shall be charged any school district or school for
special facilities and extra services as set forth and defined in
Section 2.52.230.
SECTION 4.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
