NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 12.32.020(a)
OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE
TO LICENSE AGREEMENT IN LIEU OF ENCROACHMENT
PERMIT FOR PIPELINES CONVEYING PETROLEUM
PRODUCTS.
BE IT ORDAINED by the Council of the City of

SECTION 1.
12.32.020(a) of the Bakersfield
to read as follows:
Permit requirement, application, issuance
(a) It shall be unlawful for any person, firm or
corporation to place, erect or maintain, or to permit the placing,
erection, maintenance or existence of any encroachment, as herein-
above defined, upon, over or under any street, avenue, lane,
alley, sidewalk, court, place, public way, property, or rights-
of-way, now open or dedicated or which may hereafter be opened or
dedicated to public use within the City of Bakersfield, or upon,
over or under any property belonging to the City of Bakersfield,
without a permit from the City Council granted as herein provided,
or, if the encroachment is by a pipeline for conveyance of petroleum
products to or from a refining facility, without a license agree-
ment therefor approved by the City Council.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
