AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 13.28.120 (b) OF
CHAPTER 13.28 OF THE MUNICIPAL CODE OF THE
CITY OF BAKERSFIELD RELATIVE TO MOBILEHOMES
IN R-1 ZONES (APPEAL PROCESS).
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:

SECTION 1.
Section 13.28.120 (b) of Chapter 13.28 of the
of the City of Bakersfield is amended to read
as
Mobilehomes in R-1 Zones.
(b) Refusal of Permit - Appeal.
Whenever the Building Director withholds or refuses to
issue a permit required under this section, the applicant for the
permit may, within ten (10) days from the date of the Building
Director's decision, appeal such decision to the City Council.
The City Clerk shall set the matter for public hearing before the
City Council and shall give notice of such hearing as prescribed
in Section 16.16.060(c) (1) and (2) of this code. Upon such
hearing, the City Council shall direct issuance of such permit
if, but only if, it makes the findings set forth in Subsection
(a) above. The decision of the City Council shall be final.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
