A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS SALE
WHEREAS, the City owns a fee simple interest in property at the southwest
corner of Calloway Drive and Olive Drive; and,
WHEREAS, Calloway Associates, a California general partnership has
requested the City sell this property described and depicted in Exhibit "A" attached
hereto to facilitate its new commercial development.
WHEREAS, the Bakersfield Planning Department found the sale of this property
to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to
Government Code Section 65402.
WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale
of City property deemed to be "surplus".
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing findings and recitals are true, correct, and incorporated
hereil;l.
2. Real Property located at the southwest corner of Calloway and Olive Drives
is hereby declared surplus to the City's needs and the Finance Director is authorized to
negotiate its sale.

That portion of the land Quitclaimed by the United States Department of the Interior
Bureau of Reclamation per Document No. 0206290517 a.R., filed in the Office of the
Kern County Recorder, in the City of Bakersfield, County of Kern, and State of
California, more particularly described as follows:
Commencing at the Northeast comer of Section 18, Township 29 South, Range 27 East,
Mount Diablo Base and Meridian; thence South 00034'49" West along the East line of
said section and along the centerline of Calloway Drive, a distance of 277.98 feet to a
point on the Northerly right of way line of the Calloway Canal; thence along said
Northerly right of way line, North 890 23' 49" West, a distance of 60.00 feet to a point on
the West right of way line of said Calloway Drive, said point also being the TRUE
POINT OF BEGINNING;
Thence along said Northerly right of way line, the following three courses:
1) South 89031 '01" West, a distance of67.36 feet;
2) North 58039' 00" West, a distance of349.30 feet;
3) North 22037' 49" West, a distance of 161.98 feet to a point on the South right of
way line of Olive Drive;
Thence along said South right of way line, the following five courses:
