ROLL CALL Present: Commissioners Lomas, Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish Advisory Members: Bob Sherfy, Jim Movius, Marian Shaw, Janice Horcasitas Staff: Jim Eggert, Robin Gessner, Jennie Eng 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS: None. 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items: 4.1a Approval of Minutes from December 7, 2006 meeting. Commissioner Blockley moved, seconded by Commissioner Johnson, to approve the non-public hearing items on the Consent Calendar. Motion carried by group vote. 4.2 Public Hearing Items: 4.2a Approval of Extension of Time for Vesting Tentative Tract 6250 (McIntosh &Associates) The public hearing is opened and staff report given. Mr. Webb stated that the environmental protections are inadequate as there currently is dust that blows in, there are also weeds and animals. He pointed out that these animals bring fleas and various diseases. Roger McIntosh, with McIntosh & Associates, representing Castle & Cooke, stated if the extension of time is denied then nothing would get built. He stated that the extension of time is to make sure that development of the project is completed. Mr. McIntosh stated that there are many provisions and ordinances, as well as, rules and regulations that would protect Mr. Webb's concerns, and pointed out that they would be happy to meet with Mr. Webb to resolve the issues. The public hearing is closed. Commissioner Tkac inquired about Mr. Webb's concerns. Staff responded that Mr. Webb's main concern was dust for which there are regulations on developers to keep down the dust. Staff also responded that in response to Mr. Webb's concerns about the habitat and kit foxes in the area, that this applicant has fully mitigated their endangered specious responsibilities. Commissioner McGinnis moved, seconded by Commissioner Tkac, to approve a two year extension of time for vesting tentative tract map 6250 to expire on January 14, 2009 with findings set forth in the attached Resolution Exhibit "A". Slinkard) 4.2d Approval of Vesting Tentative Parcel Map 11640 (McIntosh and Associates) The public hearing is opened. Charlie Webb requested removal of agenda item 4.2a regarding tract 6250 from the consent calendar. Commissioner Johnson requested removal of agenda item 4.2b from the consent calendar. The public hearing is closed on agenda items 4.2c and 4.2d. Commissioner Tkac moved, seconded by Commissioner Blockley, to approve agenda items 4.2c and 4.2d. Motion carried by group vote. 5. EIR/GENERAL PLAN AMENDMENTS / Land Use Circulation and Kern River Plan Elements Amendment/Zone Change/Tentative Parcel Map 5.1a West Ming Project Environmental Impact Report (EIR) for GPA/ZC 03-1544 (Castle & Cooke) 5.1 b General Plan Amendment 03-1544 (Castle & Cooke) 5.1c Adoption of the West Ming Specific Plan (Castle & Cooke) 5.1 d Zone Change 03-1544 (Castle & Cooke) The public hearing is closed and staff report given. Commissioner McGinnis stated he has reviewed Staff's responses to the City of Shafter's letter and is still in favor of this project. Commissioner Johnson stated that he has met with the applicant, and reviewed staff's responses to the City of Shafter's letter and he is still in favor of this project. Commissioner Tkac inquired if from a traffic standpoint there have been any other EIR's that have been more studied. Staff responded that they followed all the appropriate protocol for this project, and mitigated all of the impacts the best that they could. Commissioner Tragish stated that he has reviewed the comments from attorney Jones, and that he couldn't find much merit in the City of Shafter's comments. Commissioner Tragish stated that he is in support of the project. Commissioner Lomas stated that for the public's benefit and understanding she would like to explain that 47 pages of the City of Shafter letter is Fish and Wildlife proposed rules, not adopted rules and this is their argument on the shrew. Commissioner Tkac disclosed that he met with Castle & Cooke previously. Commissioners Lomas, Johnson, Blockley and Tragish have also met with Castle & Cooke while Commissioners McGinnis and Spencer were recognized as not meeting previously with Castle & Cooke. Commissioner Johnson moved, seconded by Commissioner Tkac, to adopt a Resolution attached to Planning Director's memo dated January 4, 2007, making CEQA findings section 15091 and 15093 of the State CEQA Guidelines approving mitigation measures and mitigation monitoring programs and recommending certification of the final EIR for SP GPA zone change Planning Commission — January 4, 2007 Page 3 03-1544 incorporating the memo of January 3, 2007 from Planning Director Jim Movius, and recommending the same to City Council. Motion carried by roll call vote: AYES: Commissioners Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish, Lomas NOES: None Commissioner Johnson moved, seconded by Commissioner Tkac, to adopt a Resolution attached to Planning Director's memo dated January 4, 2007, Exhibit "B", making findings and approving the requested General Plan Amendment to change designations in the Metropolitan Bakersfield General Plan Land Use Map, Circulation Map, and the Kern River Plan Element to adoption of the West Ming Specific Plan, with conditions of approval adopting a Statement of Overriding Considerations and Mitigation Monitoring Program, incorporating the memo of January 3, 2007 from Planning Director Jim Movius, and recommending the same to City Council. Motion carried by roll call vote: AYES: Commissioners Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish, Lomas NOES: None Commissioner Johnson moved, seconded by Commissioner Tkac, to adopt a Resolution attached to Planning Director's memo dated January 4, 2007, Exhibit "C", making findings approving West Ming Specific Plan with conditions of approval adopting a Statement of Overriding Considerations and Mitigation Monitoring Program, incorporating the memo of January 3, 2007 from Planning Director Jim Movius, and recommending the same to City Council. Motion carried by roll call vote: AYES: Commissioners Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish, Lomas NOES: None Commissioner Johnson moved, seconded by Commissioner Tkac, to adopt a Resolution attached to Planning Director's memo dated January 4, 2007, Exhibit "D", making findings approving the requested zone change to the zoning designations shown in the West Ming Specific Plan with conditions of approval adopting a Statement of Overriding Considerations and Mitigation Monitoring Program, and approving the development agreement, incorporating the memo of January 3, 2007 from Planning Director Jim Movius, and recommending the same to City Council. Motion carried by roll call vote: AYES: Commissioners Blockley, Johnson, McGinnis, Spencer, Tkac, Tragish, Lomas NOES: None 6. PUBLIC HEARINGS 6.1 Amendment to the Airport Land use Compatibility Plan for the Bakersfield Municipal Airport (Jim Marino) The public hearing is opened and staff report given. The applicant requested a continuance to January 18, 2007 because their airport consultant and engineering consultant were not able to be present at this meeting. Planning Commission — January 4, 2007 Page 4 Commissioner Spencer moved, seconded by Commissioner Blockley, to continue this to January 18, 2007. Motion carried by group vote. 7. PUBLIC HEARINGS — Tentative Parcel Map / Tentative Tract Maps 7.1 Tentative Parcel Map 11613 (Frank A. Slinkard) Heard on consent calendar. 7.2 Vesting Tentative Parcel Map 11640 (McIntosh and Associates) Heard on consent calendar. 8. COMMUNICATIONS: None. 9. COMMISSION COMMENTS: Commissioner Johnson advised that his place of employment has changed, and he can now be reached at the County Building on the 5th floor. Commissioner Spencer inquired of Staff as to what projects are being approved and disapproved in the Southwest and northwest. He pointed out that there is only one public works facility which is only contained within one square mile for public sewer and water. Commissioner Spencer stated that he is concerned that they are approving planned development surrounding this public facility. Staff responded that the Public Works Department is on top of this issue and has several studies that they have been looking out. Staff responded that they will see if they can put together a workshop to communicate what the plans are. Commissioner Johnson inquired about the League of California Cities Planning Commissioner conference, and staff responded they will provide the information as soon as it's available. 10.
