Commissioner Johnson moved, seconded by Commissioner Tkac, to approve Non-Public Hearing item 4.1. David Weirather with the Fire Department requested removal of Agenda Item 4.2a from the Consent Calendar. Robert P. Lusich, representative for Agenda Item 4.2b stated that they had requested some changes with the conditions of approval and Planning has not had a chance to bring them before the Commission and they would like a continuance. Staff advised that it should be removed from the Consent Calendar. Libby Mahan requested removal of 4.2e from the Consent Calendar. No commissioner requested removal of any consent calendar item. The public hearing is closed. Commissioner McGinnis, seconded by Commissioner Johnson, to approve the Consent Agenda with the exclusion of 4.2a, 4.2b and 4.2e. Motion carried by group vote. 5. PUBLIC HEARING — Approval of Amendment to the text of the Bakersfield Municipal Code, relating to architectural design standard for large retail development The proposed amendment adds new definitions for "Large Retail Development" (Section 17.04.367) and "Retail Establishments" (Section 17.04.502), and adds architectural design standards and criteria for large retail developments (Section 17.08.140). (Exempt from CEQA) The public hearing is opened, staff report given. Mr. Eggert gave his presentation. Commissioner McGinnis inquired about how many square feet expansion of an existing big box store would be required to fall within these requirements. Mr. Eggert responded that if it is a smaller center that doesn't hit the number when initially built and there is an addition that pushes it over the threshold and that addition is 50% or larger than the existing store that this requirement would kick in and is cumulative. Commissioner McGinnis inquired if it is discretionary when it kicks in, Mr. Eggert responded that it is not discretionary. He referred to item 3b on page 1 of the ordinance, and both parts would have to be met. Commissioner McGinnis inquired if the gathering areas would be minimal in size, for example, replacing 1 large gathering area into 3 smaller gathering areas. Mr. Eggert stated that it would probably work that way, but at the Staff level they will not discourage something the size of the market place. Commissioner McGinnis inquired who and how determines the aesthetic value. Mr. Eggert responded that at site plan it does not go through a hearing, but Staff and the developer will be working together, and with a PCD the Commission will be involved. No one spoke in opposition to Staff's recommendation. David Gay commended Staff for their development of this ordinance, and stated that he supports their recommendation on their design criteria. Commissioner Lomas commented on the sustainability aspect. Commissioner Johnson moved, seconded by Commissioner Tkac, to continue this item of design standards for large retail developments until March 1, 2007. PUBLIC HEARINGS —Tentative Parcel Map 6.1 Vesting Tentative Parcel Map 11548 (DeWalt Corporation) The public hearing is opened, staff report given. Dave Weirather, with the Fire Department, stated they are requesting a continuance to the next meeting in order to review the project for safety reasons. Roberto Lopez, with DeWalt Corporation, on behalf of their client, stated that they do agree with Staff's conditions of approval. Mr. Sherfy stated that the public hearing can be closed since the only remaining issue is a staff issue which can be addressed after the public hearing is closed at the next meeting. The public hearing is closed. Commissioner Johnson stated that his concern is the secondary point of access and its location. Commissioner McGinnis moved, seconded by Commissioner Johnson, to continue this item to March 1, 2007. PUBLIC HEARINGS — Tentative Tract Maps/Vesting Tract Maps/Zone Change/Planned Development Review and Specific Parks and Trails Plan Amendment 7.1 Revised Vesting Tentative Tract Map 6616 (The Lusich Company, Inc.) The public hearing is opened, staff report given. No one spoke in opposition to Staff's recommendation. Robert Lusich, representing the applicant, stated they are in agreement with Staff's recommendation. The public hearing is closed. Commissioner Spencer moved, seconded by Commissioner Tkac, to continue this item to March 1, 2007. Motion carried by the following roll call: AYES: Commissioners Johnson, McGinnis, Spencer, Tkac, Lomas NOES: None 7.2a PLID/Zone Change 06-1829 (McIntosh &Associates) Heard on Consent Calendar. 7.2b Vesting Tentative Tract Map 6696 (McIntosh &Associates) Heard on Consent Calendar. 7.3 Vesting Tentative Tract Map 6862 (Hendricks Engineering) The public hearing is opened, staff report given. Libby Mahan objected to the approval of this Tract Map 6962. She requested that the Planning Commission direct the applicant to negotiate with the beneficiaries regarding the surface right waiver and that the beneficiaries have not been compensated at this time. She stated if the applicant does not compensate the owners for their mineral interests, totaling 25%, with surface right entry that the Planning Commission require the applicant to provide a drill island and requested a 30 day continuance of this item. Jerry Hendricks with Hendricks Engineering stated they have reviewed the conditions of approval for this tract and are in agreement with them. He further indicated that they have no objection to a continuance to March 1St to give Staff an opportunity to reply to the correspondence. Commissioner Lomas requested that when this matter comes back before the Commission that they be provided with all of the correspondence. Commissioner Johnson moved, seconded by Commissioner Spencer, to continue Vesting Tentative Tract Map 6862 to the March 1St Planning Commissioner meeting. Motion carried by the following roll call: AYES: Commissioners Johnson, McGinnis, Spencer, Lomas ABSTAINED: Commissioner Tkac NOES: None Commissioner Tkac abstained due a conflict of interest. 7.4 Vesting Tentative Tract Map 6969 (McIntosh &Associates) Heard on Consent Calendar. 7.5 Vesting Tentative Tract Map 7020 (SmithTech USA) Heard on Consent Calendar. 7.6 PUD Review 07-0130 (Sikand Engineering) located east of Kern Canyon Road (Highway 184), approximately 1-1/2 miles north of Breckenridge Road, between the future extension of Edison Road on the West and Comanche Drive to the East. (Environmental Impact Report on file). Heard on Consent Calendar. 7.7 Amendment to the Specific Parks and Trails Plan for Northeast Bakersfield — Riverview Heard on Consent Calendar. 7.8 Vesting Tentative Tract Map 6961 (Phased) (Sikand Engineering Heard on Consent Calendar. 7.9 Vesting Tentative Tract Map 6962 (Phased) (Sikand Engineering) Heard on Consent Calendar. 7.10 Vesting Tentative Tract Map 6963 (Phased) (Sikand Engineering) Heard on Consent Calendar. 7.11 Vesting Tentative Tract Map 6964 (Phased) (Sikand Engineering) Heard on Consent Calendar. 8. COMMUNICATIONS: Staff commented about general plan and RFP updates and that they anticipate a kick off meeting for the GPA cycle in early April. Planning Commission — February 15, 2007 Page 5 9. COMMISSION COMMENTS: Commissioner Tkac inquired if there is any way in the future to clearly identify the parties involved in the agenda items to avoid any potential conflicts. Commissioner Johnson stated that on Page 2 of Exhibit 1 of the Draft Resolution for Agenda Item 5 his name is the only Commissioner whose full name is used, and inquired as to why that is. 10.
