HomeMy WebLinkAboutORD NO 2668ORDINANCE NO. 2668 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS 3910 SOUTH CHESTER AVENUE AND 2309 SOUTH UNION AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, commonly known as 3910 South Chester Avenue and 2309 South Union Avenue; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings. of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from C-2-D to M-l, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and ning Commission herein on file, at the hearings for a change of the recommendations of the Plan- together with the reasons advanced zoning of said properties that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: to be and a after 1. All of the foregoing recitals are hereby found true and correct. 2. Haggin as per map recorded May 3, 1889 in Book "M", Pages 5, 6, and 7 in the Office of the Kern County Recorder; Thence West 57.75 feet to a point on the Westerly right-of-way line of South Union Avenue, said point also shall be the True Point of Beginning; Thence continuing Westerly a distance of 602.32 feet; Thence South 177.22 feet to the Easterly right-of-way line of South Chester Avenue; Thence Southeast on and along said right-of- way a distance of 161.53 feet; Thence East 247.33 feet; Thence North 26° West, a distance of 151.72 feet; Thence East 301.16 + feet to a point on the Westerly right-of-w~y line of South Union Avenue; Thence North on and along said right-of-way line, a distance of 150 feet to the True Point of Beginning. ......... o0o .........
