AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 5.40.050(j) OF
THE BAKERSFIELD MUNICIPAL CODE, RELATIVE TO
PARK CURFEW, AND ADDING SECTION 5.40.050(1)

UNLAWFUL NOISE.

IT ORDAINED by the Council of the City of Bakersfield as
SECTION 1.
Section 5.40.050(j) of the Bakersfield Municipal Code is
hereby amended to read as follows:
5.40.050 Prohibited Acts in Parks.
(j) Be in or upon any park between the hours of ll p.m. and 7
a.m.; provided, however, that camping or lodging overnight may be
permitted when such camping or lodging is part of an organized
recreational outing under the supervision of the Auditorium -
Recreation Department of the City of Bakersfield or County of Kern
pursuant to a permit granted therefor by the Public Works Director.
Such application may be denied if such use is found to be inimical
to the use of any park by the general public.
SECTION 2.
Section 5.40.050(1) is hereby added to the Bakersfield
Municipal Code to read as follows:
5.40.050 Prohibited Acts in Parks.
(1) Except as allowed under permit
5.40.150, operate any radio, tape player,
player or television on or in any park, or from any vehicle parked
upon any street right-of-way within or adjacent to any' park, or in
any parking area or lot within any park, at such volume as permits
the noise therefrom to be audible to any person of normal hearing
sensitivity fifty (50) feet from said radio, tape player, tape
recorder, record player or television.

SECTION 3.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30) days
from and after the date of its passage.

meeting thereof held on the 23rd day of September , 1981, by
