AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD AMENDING SECTION 17.34.200(g) (2
OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO
REMOVAL OF NONCONFORMING SIGNS.
WHEREAS, on June 14, 1976, this Council adopted and
passed Ordinance No. 2281 (New Series) and thereby added section
17.54.200(g) (2) to the Bakersfield Municipal Code, effective
July 14, 1976, which section provides for conformation or removal
of specified nonconforming signs within five years;
WHEREAS, this Council at its meeting of May 20, 1981,
initiated a review of section 17.54.200(g) (2), which review will
involve community input and will require a period of not less
than three months;
WHEREAS, unless this Council takes action to delay the
removal or conformance date of July 14, 1981, the specified
nonconforming signs must be removed or conformed by such date;
WHEREAS, unless this ordinance is adopted as an
Emergency Ordinance, section 17.54.200(g) (2) will require sub-
stantial expenditures by property owners with nonconforming
signs, which expenditures may be proven to have been unnecessary
upon completion of the above review process; and
WHEREAS, based upon the foregoing, this Council finds
and determines that this Emergency Ordinance is necessary for
the preservation of property.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
Section 17.54.200(g) (2) of the Bakersfield Municipal
Code is hereby amended to read as follows:
17.54.200 Nonconforming Signs.
(g)(2 The following signs made nonconforming by the pro-
visions of this chapter shall be removed or made to conform with
the provisions of this chapter by October 14, 1981:
(A) Flashing signs in districts more restrictive
than the C-1 district;
(B) Flashing signs in the C-l, C-2~ M-1 and
M-2 districts which exceed the permissible current
and wattage specified in Section 17.54.040(c)(3);
(C) Moving and rotating signs except as
otherwise provided in Section 17.54.040(c) of
this chapter;
(D) Outlining of a building except as
otherwise provided in Section 17.54.040(b) of
this chapter;
(E) Signs not illuminated in accordance with
this chapter;
(F) Signs in excess of the number specified
by this chapter.
SECTION 2.
This ordinance is an Emergency Ordinance within the
meaning of Section 24 of the City Charter and is to take effect
upon passage by the City Council.
