HomeMy WebLinkAboutORD NO 2646ORDINANCE NO. 2646 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PROPERTY KNOWN AS PANAMA LANE NO. 3 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council[ of the City of Bakersfield, as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located south of the Pacheco Road alignment, north of Panama Lane, east of the Arvin- Edison canal, and west of Stine Road, known as Panama Lane No. 3 Annexation, in an R-1 (One Family Dwelling) Zone; in a C-1 (Limited Commercial) Zone; in an M-1 (Light Manufacturing) Zone; in an M-2 (General Manufacturing) Zone, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN R-1 (ONE FAMILY DWELLING) ZONE: All that portion of Section 22, Township 30 South, Range 27 East, M.D.B.&M., in the un- incorporated area County of Kern, State of California, according to the Official Plat thereof, being more particularly described as follows: Parcel 1: The South Half of said Section 22. EXCEPTING THEREFROM that portion of land lying Southerly and Westerly of the Northerly and Easterly right-of-way line of the Arvin- Edison Canal as described in deed recorded in Book 4153 at Pages 403-408 of Official Records. ALSO EXCEPTING that portion of said property lying within the line of Stine Road and Panama Lane as they now exist. ALSO EXCEPTING the Northeast Quarter of the Southeast Quarter of said Section 22. ALSO EXCEPTING that portion of said South Half described as follows: Commencing at the Northeast corner of the Southwest Quarter of said Section 22; Thence along the North line of said South- west Quarter North 8907'38" West, 310.00 feet; Thence leaving said North line South 00022'22" West, 45.00 feet to the True Point of Beginning; Thence continuing South 00022'22" West, 320.00 feet; Thence North 89037'38" West, 680.00 feet; Thence North 00022'22" East, 320.00 feet; Thence South 89037'38" East, 680.00 feet to the True Point of Beginning. Parcel 2: The South Half of the Northwest Quarter and the Southwest Quarter of the Northeast Quarter of said Section 22. EXCEPTING THEREFROM that portion of land lying Southwesterly of the Northeast right- of-way line of the Arvin-Edison Canal as described in deed recorded in Book 4153 at Pages 403-408 of Official Records. TO A C-1 (LIMITED COMMERCIAL) ZONE: All that portion of the Southwest Quarter of Section 22, Township 30 South, Range 27 East, M.D.B.&M., in the unincorporated area of the County of Kern, State of California, according to the Official Plat thereof, being more particularly described as follows: Commencing at the Northeast corner of said Southwest Quarter; Thence along the North line of said Southwest Quarter North 89°37'38" West, 310.00 feet; Thence leaving said North line South 00022'22" West, 45.00 feet to the True Point of Beginning; Thence continuing South 00°22'22" West, 320.00 feet; Thence North 89037'38" West, 680.00 feet; Thence North 00~22'22" East, 320.00 feet; Thence South 89~37'38" East, 680.00 feet to the True Point of Beginning. TO AN M-1 (LIGHT MANUFACTURING ZONE): All that portion of the North Half of the Northwest Quarter and the Northwest Quarter of the Northeast Quarter of Section 22, and the Northeast Quarter of Section 21, Town- ship 30 South, Range 27 East, M.D.B.&M., in the unincorporated area, County of Kern, State of California, according to the Official Plat thereof, being more particularly described as follows: Parcel 1: Beginning at the Southeast corner of the Northwest Quarter of the Northeast Quarter of said Section 22; Thence along the South line of said Northwest Quarter of the Northeast Quarter, North 89~45'28" West, 1,325.29 feet to the South- east corner of the North Half of the North- west Quarter of said Section 22; Thence along the South line of said North Half, North 89035'55" West, 2,650.40 feet to the West line of said Section 22; Thence along said West line North 00°12'58" East, 580.00 feet; Thence leaving said West line South 89°35'55" East, 2,649.43 feet to the East line of the Northwest Quarter of said Section 22; Thence South 89°45'28" East, 1,324.82 feet to the East line of the Northwest Quarter of the Northeast Quarter of said Section 22; Thence along said East line South 00~04'26" West, 580.01 feet to the Point of Beginning. Parcel 2: That portion of the Northeast Quarter of said Section 21 lying Easterly and Northerly of the Northeast right-of-way line of the Arvin-Edison Canal as described in deed recorded in Book 4153 at Pages 403- 408 of Official Records, and lying Southerly and Easterly of the Southeast right-of-way line of the Stine Canal, as it presently exists. TO AN M-2 (GENERAL MANUFACTURING) ZONE: All that portion of the North Half of the Northwest Quarter and the Northwest Quarter of the Northeast Quarter of Section 22 and of the Northeast Quarter of Section 21, Township 30 South, Range 27 East, M.D.B.&M., and of the Northeast Quarter of Section 21, Township 30 South, Range 27 East, M.D.B.&M., in the unincorporated area County of Kern, State of California, according to the Official Plat thereof, being more particu- larly described as follows: Parcel 1: Beginning at the Northeast corner of the Northwest Quarter of the Northeast Quarter of said Section 22; Thence along the East line of said Northwest Quarter of the Northeast Quarter, South 00004'26" West, 740.48 feet; Thence leaving said East line North 89045'28" West, 1,324.82 feet to a point on the East line of the Northwest Quarter of said Section 22; Thence North 890!35'55" West, 2,649.43 feet to the West line of said Northwest Quarter; Thence along said West line, North 0012'58" East, 746.01 feet to the Northwest corner of the Northwest Quarter of said Section 22; Thence along the North line of said Section 22, South 89°34'11" East, 2,648.20 feet to the Northeast corner of said Northwest Quarter; Thence continuing along said North line, South 89034'33" East, 1,324.23 feet to the Point of Beginning. EXCEPTING THEREFROM that portion, if any, within the strip granted to the Southern Pacific Railroad Company in deed recorded Book 63, Page 5 of Deeds. Parcel 2: All that portion of the Northeast Quarter of said Section 21 lying Easterly and Northerly of the Northeast right-of-way line of the Arvin-Edison Canal as described in deed recorded in Book 4153 at Pages 403- 408 of Official Records, and lying Northerly and Westerly of the Northwest right-of-way line of the Stine Canal, as it presently exists. EXCEPTING THEREFROM that portion, if any, within the strip granted to the Southern Pacific Railroad Company in Deed recorded in Book 63, Page 5 of Deeds. SECTION 2. This ordinance shall become effective upon the annexation of the above-described territory to the City of Bakersfield. ......... o0o .........
