EMERGENCY ORDINANCE NO. 2639

AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD AMENDING CHAPTER 7.12 OF
THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD
BY ADDING SECTION 7.12.035 AND AMENDING SECTIONS
7.12.010, 7.12.040 AND 7.12.200 RELATIVE TO
BINGO GAMES.
BE IT ORDAINED by the Council of the City of Bakersfield as
SECTION 1.
Section 7.12.010 of the Municipal Code of the City of
Bakersfield is amended to read as follows:
7.12.010 Organizations Eligible For City License to Conduct
Bingo Games. The following are eligible to apply to the City of
Bakersfield for a license to conduct bingo games in the City under
the provisions of Section 326.5 of the Penal Code of the State of
California and the provisions of this chapter, provided that each
such organization or association establishes to the satisfaction of
the City Manager that it has actively engaged in the activities
described in its articles of incorporation or by-laws within the City
of Bakersfield for a period of not less than six months immediately
preceding the date of its application.
(1) Organizations exempted from the payment of the bank and
corporation tax by Sections 23701(a), 23701(b), 23701(d), 23701(e),
23701(f), 23701(g), and 23701(1) of the Revenue and Taxation Code of
the State of California;
(2) Mobilehome Park Associations; and
(3) Senior Citizens Organizations with a membership requiring
that the member, or the member's spouse be fifty years of age or
older.
SECTION 2.
Section 7.12.035 of the Municipal Code of the City of
Bakersfield is added to read as follows:
7.12.035 Licensing of Inter-related Organizations and Associations
Prohibited. No license shall be issued to any organization or
association if a director, officer, or salaried or paid employee of
the applicant is a director, officer, or salaried or paid employee of
an organization or association licensed to conduct bingo games under
the provisions of this chapter.
SECTION 3.
Section 7.12.040 of the Municipal Code of the City of
Bakersfield is amended by amending subsection (4) and adding sub-
section (9) to read as follows:
7.12.040 Contents of Application.
(4) Proposed day of the week and hours of day for conduct of
bingo games.
(9) The name and address of each director, officer, and
salaried or paid employee of the applicant organization or associa-
tion.
SECTION 4.
Section 7.12.200 of the Municipal Code of the City of
Bakersfield is amended to read as follows:
7.12.200 Hours and Days of Operation. No licensee shall conduct
bingo games more than six hours out of any twenty-four hour period,
nor more than once per week. No bingo game shall be conducted
before 10 a.m. nor after 2 a.m. of any day. The day upon which the
licensee shall be authorized to conduct bingo games shall be stated
on the license.
SECTION 5.
This ordinance is declared to be an emergency ordinance
pursuant to Section 24 of the Charter of the City of Bakersfield,
shall become effective immediately upon its passage.
