HomeMy WebLinkAboutORD NO 2627ORDINANCE NO. 2627 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PROPERTY KNOWN AS COLLEGE NO. 3 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties located easterly of Valencia Drive, between College Avenue on the north, and East Niles Street on the south, and known as College No. 3 Annexation, in an R-1 (One Family Dwelling) Zone; in an R-1-CH (One Family Dwelling-Church) Zone; in an R-2-D-CH (Limited Multiple Family Dwelling-Architectural Design-Church) Zone; and in an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN R-1 (ONE FAMILY DWELLING) ZONE: The following legal refers to the Corporate Boundary as it existed on July 1, 1980. A parcel of land situated in the County of Kern, State of California, being a portion of the North Half of Section 25, Township 29 South, Range 28 East, M.D.M., and a portion of the North Half of Section 30, Township 29 South, Range 29 East, M.D.M., more particu- larly described as follows: Beginning at the intersection of the South line of the North 1,022.39 feet of said Section 30 with the East line of the West 55 feet of the last named section, said inter- section being a point on the exterior Corporate Boundary of the City of Bakersfield, and being also the True Point of Beginning for this description; THENCE (1) departing from said Corporate Boundary Southerly along last named East line a distance of 332 feet, more or less, to intersect the South line of the North 30 feet of the South Half of the North Half of said Section 30, said line also being the Easterly extension of the South right-of-way line of Willis Avenue; Thence (2) Westerly along the last named South line and the South line of the North 30 feet of the South Half of the North Half of said Section 25, a distance of 1,348 feet, more or less, to a point in the East line of the West 30 feet of the East Half of the East Half of said Section 25, said line also being the East right-of-way line of Park Drive; THENCE (3) Southerly along the last named East line and right-of-way line a distance of 1,273 feet, more or less, to a point in the North line of the South 50 feet of the North Half of said Section 25, said point also being a point in the North right-of-way line of East Niles Street; THENCE (4) Westerly along last named North line, a distance of 1,769.38 feet, more or less, to a point in the East boundary line of Tract 1744, as shown in Map Book 9 at Page 14 in the Office of the Kern County Recorder; THENCE (5) along the exterior boundary line of Tract Nos. 1744, 1861 and 2490 the follow- ing five (5) courses: North 0°31'45" East, a distance of 1,099.99 feet; 2 o THENCE (6) North 89°44'15" East, a distance of 44.43 feet; THENCE (7) North 0°28'41" East, a distance of 470.04 feet; THENCE (8) South 89°44'15" West, a distance of 70.01 feet; THENCE (9) North 0°28'41" East, a distance of 978.47 feet, more or less, to intersect the South right-of-way line of College Avenue, said intersection being a point in said exterior Corporate Boundary; THENCE (10) Easterly and along various courses of said exterior Corporate Boundary to the Point of Beginning. EXCEPTING THEREFROM the Southerly 660 feet; that portion within Parcel Map 2974 recorded July 24, 1975, in Book 14, Page 16 of Maps in the Office of the Kern County Recorder; and within Park Drive, Morning Drive, and Willis Avenue rights-of-way. TO AN R-1-CH (ONE FAMILY DWELLING-CHURCH) ZONE: All of Parcel Map 2974, County of Kern, State of California, as per map recorded July 24, 1975, in Book 14, Page 16 of Maps in the Office of the Kern County Recorder. EXCEPTING THEREFROM Willis Avenue and Morning Drive rights-of-way. TO AN R-2-D-CH (LIMITED MULTIPLE FAMILY DWELLING-ARCHITECTURAL DESIGN-CHURCH) ZONE: The South 450 feet of the East 192.01 feet of the Northwest Quarter of Section 25, Township 29 South, Range 28 East, M.D.B.&M. EXCEPTING THEREFROM the East Niles Street right-of-way. TO AN R-2-D (LIMITED MULTIPLE FAMILY DWELL- ING-ARCHITECTURAL DESIGN) ZONE: The South Half of the Southwest Quarter of the Northeast Quarter and the Southeast Quarter of the Southeast Quarter of the Northwest Quarter of Section 25, Township 29 South, Range 28 East, M.D.B.&M. EXCEPTING THEREFROM the South 450 feet of the East 192.01 feet of the Northwest Quarter of said Section 25; that portion within Tract 1744, recorded August 26, 1955 in Book 9, Pages 14 through 16, County of Kern, State of California; and within East Niles Street and Park Drive rights-of-way.
