RESOLUTION NO. 0 5 9 - 0 7
A RESOLUTION OF APPLICATION PROPOSING
PROCEEDINGS FOR ANNEXATION OF TERRITORY TO
THE CITY OF BAKERSFIELD AS ANNEXATION NO. 610
LOCATED SOUTH OF OLIVE DRIVE, WEST OF STATE
FREEWAY 99. (WARD 3).
WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the
annexation to the City of Bakersfield ofthe hereinafter-described territory, pursuant to Section 56654
of the Government Code of the State of California; and
WHEREAS, the proposed annexation territory is within and consistent with the City of
Bakersfield Sphere of Influence boundary; and
WHEREAS, the City of Bakersfield agrees to annex the territory located south of Olive Drive,
west of State Freeway 99; and
WHEREAS, the City has agreed to serve the territory upon annexation; and
WHEREAS, the property owner of the territory has consented to annexation to the City of
Bakersfield; and
WHEREAS, the territory has already been annexed into the North of the River Sanitary
District NO.1 as adoption by Resolution No. 69; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it
hereby finds and determines as follows:
1. That the City of Bakersfield hereby proposes the annexation to the City of
Bakersfield of the territory in Exhibit "A" and shown on map marked Exhibit liB"
attached hereto and made a part of this resolution as though fully set forth herein,
located south of Olive Drive, west of State Freeway 99.
2. That a plan for providing services within the affected territory of the proposed
annexation, in accordance with the provisions of Section 56653 of the Government
Code, is marked as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
3. That this proposal for change of organization, to wit, annexation, is made pursuant to
the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, and it is
requested that proceedings be authorized for annexation in accordance therewith.
4. That the reasons for the proposed change of organization are that the owners of the
affected territory desire to receive municipal services from the City of Bakersfield,
and the City desires to receive tax revenues for benefits given and to be given to the
territory proposed to be annexed.

5. That for this proposed annexation territory and the prezoning therefore, the City
prepared an environmental document in accordance with State CEQA guidelines
and will use the environmental document for the proposed prezoning and
annexation.
6. That the laws and regulations relating to the preparation and adoption of the
environmental document as set forth in the California Environmental Quality Act
have been duly followed.
7. That the territory proposed for annexation as described herein has been determined
to be uninhabited pursuant to Section 56046 of the Government Code.
8. That the territory proposed for annexation as described herein has been determined
to have 100% of property owners consenting to annexation.
9. That the territory proposed for annexation as described herein is within the City of
Bakersfield Sphere of Influence Boundary.
10. That the territory is already annexed into the North of the River Sanitary District NO.1
as adopted by Resolution No. 69.
10. That the Local Agency Formation Commission waive the protest hearing
proceedings pursuant to Part 4, commencing with Section 57000 of the Cortese-
Knox-Hertzberg Local Government Reorganization Act of 2000.
11. That the names of the officers of the City of Bakersfield who are to be furnished with
copies of the Executive Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

A parcel of land being portions of the Southeast quarter of Section 10, the Southwest
quarter of Section 11, the Northwest quarter of Section 14, and the Northeast quarter of
Section 15, Township 29 South, Range 27 East, Mount Diablo Base and Meridian, in the
County of Kern, State of California, more particularly described as follows:
Beginning at a point on the North line of said Northeast quarter of Section 15, also being
the centerline of Olive Drive (County Road No. 276 and 2471), North 89010'38" West,
387.42 feet distant from the Northeast comer of said Section 15;

services (Le" need for additional emergency service personnel or construction of new facilities,
etc)? The annexation of this territorv will have minimal effect on the near term level or caoabilitv

would oossiblv be reauired to maintain the current level of citv service, The olanned develooment

maintenance resoonsibilitv of the Citv but should not affect the existina level of service,

fire hydrants, mains, etc,): If so, would city/district or developers be responsible for financing?
No. if anv additional develooment occurs. the develooer orovides and oavs for maior facilities and
dedicates them to the Citv. No uoaradina or chanae in facilities will be reauired in the territorv for
annexation,

Aariculture).

adooted Ordinance No. 4309 chanaina the orezonina from A (Aariculture) to M-2 (General
Manufacturina).
5. List city/district services that area will directly or indirectly benefit from such as decrease in fire
insurance rate, shorter emergency response time, use of community facilities, etc. Citv Police
should be able to resoond in a more timelv manner than present Countv Sheriff services, Parcels
within the incoroorated area are allowed to connect to available North of the River Sanitarv
District No, 1 sewer svstem lines. The oresent Citv refuse collection rate is substantiallv lower
than fees countv residents now oav to indeoendent comoanies. No soecial assessments or
charaes for street sweeoina. leaf collection, street liahtina enerav costs and fire hvdrants when
located within the Citv's incoroorated area, Citv aovernment also provides increased political
reoresentation for the residents within the coroorate limits,

List existing tax rate(s) in area, The existina tax rate in the area eauals 1,129915% of assessed
market value. This reoresents the total orooertv tax rate, When annexed a desianated
oercentaae of the total orooertv tax of the area will accrue to the Citv and remainder to the
Countv for orovidina health care and social services. (Rate as shown on 2005-2006 Countv
Auditor-Controllers 2005 Lien Date),
7. Would affected area be subject to any bonded indebtedness of the city/district?: If so, explain,
No. the tax rate list shows no citv bonded indebtedness.
8, How will the difference in tax rates affect a property with a market value of $50,000,OO?
The orooertv rate will not increase due to annexation and re-assessment will not occur due to
annexation.
9. Is the proposed area subject to a Williamson Act Contract? No. the existina annexation area is
not subiect to a Williamson Act Contract.
