HomeMy WebLinkAboutORD NO 2614ORDINANCE NO. 2614 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHEAST CORNER OF GOSFORD ROAD AND WHITE LANE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, located on the northeast corner of Gosford Road and White Lane; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-1 to R-2-D and C-2-D and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said properties that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO AN R-2-D (LIMITED MULTIPLE FAMILY DWELLING- ARCHITECTURAL DESIGN) AND TO A C-2-D (COMMERCIAL-ARCHITECTURAL DESIGN ZONE: R-1 TO R-2-D That portion of Section 16, Township 30 South, Range 27 East, M.D.B.&M., described as follows: Parcel 1: Commencing at the West Quarter corner of said Section 16; Thence along the West line of said Section North 00°39'06" East, 1,340.07 feet, more or less to a point on the Southwesterly boundary of the right-of-way for the Arvin- Edison Canal; Thence Southeasterly along said South- westerly boundary 57.99 feet to the point of intersection of said Southwesterly boundary with the Easterly right-of-way line of Gosford Road, said point being the True Point of Beginning; Thence continuing along the Southwesterly boundary of the said Arvin-Edison Canal: (1) South 70052'43" East, 14.91 feet; (2) South 55°53'15" East, 103.49 feet; (3) South 40054'08" East, 451.96 feet; Thence North 89020'54" West, 400.28 feet to a point on the Easterly right-of-way line of said Gosford Road; Thence along said Easterly right-of-way line North 00°39'06" East, 400.00 feet to the True Point of Beginning. o Parcel 2: Commencing at the West Quarter corner of said Section 16; Thence along the West line of said Section North 00039'06" East, 113.50 feet to the point of inter- section of the centerline of Gosford Road with the centerline of White Lane; Thence along the centerline of said White Lane South 89012'47" East, 1,174.13 feet to a point on the Southwesterly right-of-way line of the Arvin- Edison Canal; Thence along said Southwesterly right-of-way line North 40054'08" West, 73.65 feet to the point of intersection of said Southwesterly boundary with the Northerly right-of-way line of said White Lane, said point being the True Point of Beginning; Thence continuing along the said Southwesterly boundary of the Arvin-Edison Canal, North 40054'08" West, 601.42 feet; Thence South 00°47'13" West, 449.12 feet to a point on the North right-of-way line of said White Lane; Thence along said North right-of-way line South 89012'47" East, 400.00 feet to the True Point of Beginning. R-1 TO C-2-D That portion of Section 16, Township 30 South, Range 27 East, M.D.B.&M., described as follows: Commencing at the West Quarter corner of said Section 16; Thence along the West line of said Section North 00039'06" East, 917.56 feet; Thence South 89020'54" East, 55.00 feet to a point on the East line of Gosford Road, said point being the True Point of Beginning; Thence continuing South 89020'54" East, 400.28 feet to a point on the Southwesterly boundary of the right-of-way for the Arvin-Edison Canal; Thence along said Southwesterly boundary South 40054'08" East, 408.63 feet; Thence South 00°47'13" West, 449.12 feet to a point on the North right-of-way line of White Lane; Thence along said North right-of-way line North 89012'47" West, 650.32 feet to the beginning of a curve concave Northeasterly of radius 20.00 feet; Thence Northwesterly along said curve through a central angle of 89051'53" an arc distance of 31.37 feet to a point on the Easterly right-of-way line of said Gosford Road; Thence along said Easterly right-of-way line North 00039'06" East, 733.38 feet to the True Point of Beginning. .......... o0o ..........
