HomeMy WebLinkAboutORD NO 2601ORDINANCE NO. 2601 [~EW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 8.48.130(d) AND 8.48.160(a) AND ADDING SECTIONS 8.48.130(e) AND 8.48.130(f) TO THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO REFUSE COLLECTION POINTS. BE as follows: IT ORDAINED by the Council of the City of Bakersfield SECTION 1. Section 8.48.130(d) of the Bakersfield Municipal Code is amended to read as follows: 8.48.130 Refuse Collection Points (d) In no event shall the Collector be required to collect residential refuse through any gate, nor shall such collector be required to collect refuse through any trellis, pergola, arbor, clothesline, carport or within any enclosed structure. It shall be the responsibility of the person receiving refuse collection service to provide free and proper access to refuse containers. SECTION 2. Section 8.48.160(a) of the Bakersfield Municipal Code is amended to read as follows: 8.48.160 Enforcement--Powers and Duties of Director of Public Works. (a) The Director of Public Works shall supervise the collec- tion and removal of all refuse by the City and shall enforce the provisions of this chapter. SECTION 3. Section 8.48.130(e) of the Bakersfield Municipal Code is added to read as follows: 8.48.130 Refuse Collection Points (e) Detachable bin refuse containers shall be placed on four-inch thick, six foot by eight foot concrete slabs at grade level or on slabs of similar construction or material if approved by the Public Works Director. SECTION 4. Section 8.48.130(f) of the Bakersfield Municipal Code is added read as follows: 8.48.130 Refuse Collection Points (f) The Director of Public Works may require an enclosed structure around detachable bin refuse containers if he determines an unenclosed bin to be unsightly. SECTION 5. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
