HomeMy WebLinkAboutORD NO 2598ORDINANCE NO. 2598 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE 7 OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO BUSINESS REGULATIONS AND PERMITS BY REPEALING SECTIONS 7.02.020 AND 7.02.030 (POSTING HANDBILLS), 7.08.020(d) (3) (SOUND EQUIPMENT), 7.18.200 (JUNK DEALERS), 7.28.040(a) AND (b) AND 7.28.050(a) (ADULT BOOKSTORES), 7.40.170 (ADMISSION FEES AT PUBLIC DANCES), AND CHAPTER 7.60 (TRAMPOLINE CENTERS), AND BY AMENDING SECTIONS 7.16.020 (MESSENGER SERVICE), 7.48.010 AND 7.48.020(4) (HOTELS AND LODGING HOUSES), 7.52.010(b) AND 7.52.130(d) (TAXICABS), 7.56.010 (TRANSIENT PHOTOGRAPHERS' BONDS), 7.64.030(c) (1) (POLICE AND FIRE ALARM SYSTEMS), AND 7.90.010 (OUTDOOR FESTIVALS). BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Sections 7.02.020 and 7.02.030 of the Bakersfield Municipal Code are hereby repealed. SECTION 2. Section 7.08.020(d) (3) of the Bakersfield Municipal Code is hereby repealed. Section 7.18.200 hereby repealed. SECTION 3. of the Bakersfield Municipal Code is SECTION 4. Chapter SECTION 6. 7.60 of the Bakersfield Municipal Code is hereby SECTION 7. Section 7.16.020 of the Bakersfield Municipal Code is amended to read as follows: 7.16.020 Application For Permit--Investigation--Issuance. (a) No permit shall be granted except upon the written application of the person, firm or corporation desiring same. Said application shall be signed by the applicant and shall provide the following information: (1) If the applicant is a partnership or corporation, the names and residence addresses of the principal owners thereof; (2) The location of the place of business of the applicant and of each premises from which the proposed service shall be provided; (3) A detailed explanation of the services the applicant proposes to provide; and, (4) The name of the company or companies bonding the applicant and each employee to be used as a messenger, and the numbers of the policies providing such coverage (such bonding is required). (5) The names and addresses of the applicant, the applicant's employees, agents, and any other persons associated with the applicant as partners, directors, officers, shareholders, associates or managers in the proposed conduct of the messenger service, and, as to each such person, any commission or conviction of any criminal act (excluding minor traffic offenses for which the fine or bail for- feitures did not exceed Twenty-five Dollars ($25). (b) The application shall be referred to the Chief of Police for investigation who shall investigate the information provided in the application and the character of the applicant, and shall, within five (5) days, report thereon to the City Manager. After receiving such report, the City Manager shall grant the permit if he finds that the information set forth in the application is true and correct and that the applicant and those associated with the applicant in the conduct of the business are of good character. SECTION 8. Section 7.48.010 of the Bakersfield Municipal Code is amended to read as follows: 7.48.010 Permit Required. It shall be unlawful for any person, firm or corporation to keep, maintain, run or conduct any hotel lodging house, motel, rooming house or apartment house in the City of Bakersfield, without first having procured a permit to do so, from the City Manager, such permits to be renewed annually, pro- vided, however, that the provisions of this chapter shall not apply to private houses with permanent tenants as distinguished from transients, in which not more than two rooms or not more than two apartments are rented or leased or held out to be rented or l~ased. SECTION 9. Section 7.48.020(4) of the Bakersfield Municipal Code is amended to read as follows: 7.48.020 Application For Permit--Grounds For Denial (4) That the applicant is in violation of Chapter 6.12 of the Municipal Code of the City of Bakersfield. SECTION 10. Section 7.52.010(b) of the Bakersfield Municipal Code is amended to read as follows: 7.52.010 Permit Required--Exceptions. (b) A vehicle being operated pursuant to a franchise issued by the City of Bakersfield, pursuant to authority of the Public Utilities Commission of the State of California, or pursuant to regulations of the Interstate Commerce Commission, unless authorized by law. SECTION 11. Section 7.52.130(d) of the Bakersfield Municipal Code is amended to read as follows: 7.52.130 Taximeter--Operation, Placement, Inspection, Flag, Charges. (d) Every taximeter shall be inspected and tested for accuracy by the carrier at least once each year. Upon the completion of such inspection and of any adjustments necessary to cause such taximeter to operate within the standards of accuracy approved by the Chief of Police, the carrier shall cause to be placed upon such meter a gummed label having printed thereon the following: "This taximeter was inspected and tested on (date), and found to comply with standard of accuracy prescribed by the Chief of Police of the City of Bakersfield, California." The date on which such inspection was made shall be stamped in the blank space provided for that purpose. No such label shall be removed except at the time a subsequent inspection is made. SECTION 12. Section 7.56.010 of the Bakersfield Municipal Code is amended to read as follows: 7.56.010 Definitions. The words TRANSIENT PHOTOGRAPHER and TRANSIENT PHOTO FINISHER as used in this chapter shall be deemed to mean and include each person, whether acting as principal, agent or employee, who engages in the business of doing any of the following acts in the City of Bakersfield for the purpose of securing financial gain therefrom, who has financial transactions with residents of the City concerning performance of his trade, and who does not have a regular and permanent place of business within the City of Bakersfield: Taking or making photographic portraits or photographic (a) views. (b) Selling, offering for sale, soliciting for the sale of, bargaining or bartering for, exchanging or giving away any photographs, or enlargements of photographs by any means whatsoever. (c) Soliciting for, collecting, receiving or delivering photo finishing, exposed roll films, exposed negatives, film packs, exposed cut films, or exposed glass plates. SECTION 13. Section 7.64.030(c) (1) of the Bakersfield Municipal Code is amended to read as follows: 7.64.030 Central Station Systems. (c) (1) Compliance with "Standard for Safety," Central Station Burglar-Alarm Units and Systems (UL 611-1972) issued by Underwriters' Laboratories, Inc. or with "Standard for Safety," Central Stations for Watchman, Fire-Alarm and Supervisory Services (UL 827-1972) issued by Underwriters' Laboratories, Inc., or both. Such standards are adopted and made a part of this chapter, and a copy of such standards shall be kept on file with the City Clerk and be available for public inspection. The service provided may correspond to any of the several grades of service listed in the standards. SECTION 14. Section 7.90.010 of the Bakersfield Municipal Code is amended to read as follows: 7.90.010 Definition--Outdoor Festival. "Outdoor festival," when used in this chapter, means any outdoor music festival, dance festival, "rock" festival or similar musical activity, at which music is provided by paid or professional or amateur performers, or by prerecorded means, or any demonstration-type assembly either with or without music in any form, to which members of the public are invited or admitted for a charge or free of cost and which is attended by more than five hundred persons; provided, however, that the term "outdoor festival" shall not include any activity located entirely upon any publicly owned or operated grounds with the permission of the appropriate authorities. SECTION 15. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
