RESOLUTION NO. 0 4 7 - 0 7
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE REQUISITE CITY
PERSONNEL TO EXECUTE ALL DOCUMENTS
REQUIRED TO SUBMIT CLAIMS TO THE CALIFORNIA
OFFICE OF EMERGENCY SERVICES.
WHEREAS, in January, 2007, severe cold weather resulted in freezing
conditions in the Bakersfield area; and
WHEREAS, these conditions caused damage to City property, resulting from
burst water pipes in irrigation systems; and
WHEREAS, the City's property insurance policy does not cover irrigation
systems and contains a $25,000.00 deductible; and
WHEREAS, damage to property other than irrigation systems did not exceed the
deductible; and
WHEREAS, the Governor declared an emergency as a result of the freeze; and
WHEREAS, the City can recover up to seventy-five percent (75%) of the
damages incurred from the California Office of Emergency Services ("COES"); and
WHEREAS, COES requires the City to designate an agent that will present its
claim to COES; and
WHEREAS, the City desires this designation to apply to this and any future claim
arising from any future occurrences.

NOW, THEREFORE, BE IT RESOLVED, incorporating the above recitals herein,
by the Council of the City of Bakersfield as follows:
1. That the above recitals are true and correct; and
2. The City Manager, any Assistant City Manager or the Finance Director are
designated to prepare and present claims to the California Office of
Emergency Services (COES) for reimbursement for damage caused by
any declared emergency or disaster for which COES will accept claims.
3. Staff is instructed to complete OES Form 130 attached hereto as Exhibit
"A" and forward it to COES.
