HomeMy WebLinkAboutORD NO 2577ORDINANCE NO. 2577 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHEAST CORNER OF WHITE LANE AND STINE ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the northeast corner of White Lane and Stine Road; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-2-MH-D to C-2-D and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council sideration of said petition and ning Commission herein on file, at the hearings for a change of zoning change should be authorized, subject conditions: a) b) c) has determined after due con- the recommendations of the Plan- together with the reasons advanced zoning of said property that a to the following Dedicate a 25-foot wide strip of right-of- way along Stine Road. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the Land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN R-2-MH-D (LIMITED MULTIPLE FAMILY DWELLING-MOBILEHOME-ARCHITECTURAL DESIGN) ZONE TO A C-2-D (COMMERCIAL-ARCHITECTURAL DESIGN) OR MORE RESTRICTIVE ZONE: Parcel 1 That portion of the Southwest Quarter of the Northwest Quarter of Section 14, Town- ship 30 South, Range 27 East, M.D.B.&M., in the City of Bakersfield, County of Kern, State of California, according to the Official Plat of said land approved by the Surveyor General, June 1, 1855, described as follows: Beginning at a point in the West line of the Southwest Quarter of the Northwest Quarter of Section 1 as above, distant from the Northwest corner of the Southwest Quarter of the Northwest Quarter of said Section 14, South 365.03 feet, such point of beginning lying in the centerline of certain ditch; Thence along the West line of the Southwest Quarter of the Northwest Quarter of said Section 14, South 959.57 feet, more or less, to the Southwest corner of the Southwest Quarter of the Northwest Quarter of said Section; Thence along the South line of the Southwest Quarter of the Northwest Quarter of said Section 14, South 89°39'00" East, 622.41 feet to a point in the centerline of a certain ditch the same above referred to; Thence along the centerline of said ditch North 30~09'00" West, 100.46 feet; Thence along the center of said ditch North 39719'00" West, 158.16 feet; Thence along the centerline of said ditch, North 10~59'00" West, 39~.52 feet; Thence along the centerline of said ditch North 28°34'30" West, 60.45 feet; Thence along the centerline of said ditch North 46"10'00" West, 451.64 feet; Thence along the centerline of said ditch due West 41.66 feet to the point of be- ginning. EXCEPT all that portion of said land lying Southerly of the North right-of- way line of White Lane (taken by the County of Kern in the Final Order of Condemnation recorded April 7, 1966 in Book 3937, Page 361, Official Records); ALSO EXCEPT that certain parcel being a portion of the Southwest Quarter of the Northwest Quarter of Section 14, Township 30 South, Range 27 East, M.D.B.&M., in the City of Bakersfield, County of Kern, State of California, de- scribed as follows: Beginning at a point in the West line of the Southwest Quarter of the Northwest Quarter of Section 14, as above, distant from the Northwest corner of the South- west Quarter of the ~orthwest Quarter of said Section 14, South 00°04'31" West, 365.03 feet, such point of beginning lying in the centerline of a certain ditch (defined as the Anderson Canal); Thence along said West line, South 00°04'31" West, 483.59 feet; Thence at right angles, South 89"55'29" East, 419.27 feet to a point in the center- line of said Anderson Canal; Thence along said centerline the follow- ing courses and distances (1) North 10°53'49" West, 119.69 feet; Thence (2) North 28e29'19" West, 60.45 feet; Thence (3) North 46°05'03" West, 451.88 feet; Thence (4) North 89°55'29" West, 41.66 feet to the point of beginning.
