HomeMy WebLinkAboutORD NO 2569ORDINANCE NO. 2569 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD COMMONiLY KNOWN AS 1022, 1024, AND 1030 - 8TH STREET; AND 810 AND 814 "N" STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of certain properties in the City of Bakersfield, commonly known as 1022, 1024, and 1030 - 8th Street; and 810 and 814 "N" Street; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-3 to C-O and the Council has considered said findings and all appear to be true and correct; anJ WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and ning Commission herein on file, at the hearings for a change of the recommendations of the Plan- together with the reasons advanced zoning of said properties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 Code of the City of Bakersfield, by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: (Zoning Map) of the Municipal be and the same is hereby amended FROM AN R-3 (LIMITED MULTIPLE FAMILY DWELL- ING) ZONE TO A C-O-D (COMMERCIAL AND PROFESSIONAL OFFICE-ARCHITECTURAL DESIGN) ZONE: Lots 13, 14, 15, and 16, Block 42, Lowell Addition, City of Bakersfield, County of Kern, State of California, as per map recorded November 25, 1898, in Map Book 1 at Pages 13 and 14 in the Office of the Kern County Recorder. .......... o0o .......... o I HEREBY CERTIFY that the foregoing Ordinance was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 30th day of July , 1980, by the following vote: CITY CLERK and Ex ~ficio Clerk of the Council of the City of Bakersfield APPROVED this .~O~i'/'~'~C~ %~ of ,akersf ield , 1980 APPROVED as to form: CITY ATTORNEY of the ~ty of Bakersfield Affidavit of ost ng ( r iuau es STATE OF CALIFORNIA, f County of Kern ss.
