AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING CHAPTER 3.18 OF THE
MUNICIPAL CODE BY AMENDING CERTAIN SECTIONS
AND ADDING OTHERS, ALL IN RELATION TO
COMPENSATION FOR OFFICERS AND EMPLOYEES
OF THE CITY OF BAKERSFIELD.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Sections 3.18.110(c) (1) and 3.18.110(e) of the Municipal
Code of the City of Bakersfield are amended to read as follows:
(c) (1) Leadman Responsibilities. When an employee in the
Classification Equipment Operator II, Light Equipment Operator -
Streets, Heavy Equipment Operator - Streets, Equipment Operator
III, Tree Maintainer II or Sewer Maintainer is assigned to leadman
responsibilities for the majority of a shift to a project, truck
or job, he shall receive a salary adjustment increase of five
percent during the period of such assignment.
(e) Shift Differential. A shift differential of thirty-five
cents per hour will be paid any blue or white collar employee when
the majority of their shift falls between the hours of three (3)
and seven a.m.
SECTION 2.
Sections 3.18.140(e) (1) and 3.18.140(f) of the Municipal
Code of the City of Bakersfield are amended to read as follows:
(e) (1) Eligible employees designated by the letters (A),
(B), or (C) preceeding each class title in the Salary Schedule,
as adopted by Resolution of the City Council, may accumulate over-
time as compensatory time. Such compensatory time shall not
exceed sixty (60) hours. All overtime worked beyond the specified
maximum shall be paid in accordance with Administrative Rules and
Regulations. Accumulation of more than the specified maximum shall
require prior approval of the City Manager.

(f) Overtime--Call-back Firefighting. Employees of the
Fire Department called back to fight a fire shall be compensated
with a credit of compensatory time off at two times the hours of
overtime worked or equivalent pay as determined by the department
head. Such overtime for those employees assigned to a twenty-four-
hour duty shift shall be converted to a fraction of a shift for
purposes of recording compensatory time earned. Fire suppression
employees called back, after being relieved, shall be compensated
for a minimum of two hours.
SECTION 3.
Section 3.18.154 of the Municipal Code of the City of
Bakersfield is amended to read as follows:
3.18.154 Stand-by--Additional Compensation--Except Police and
Fire Suppression--Additional Compensation For Fire Prevention.
(a) If an employee, other than a Police or Fire Suppression
employee, who is on call is not confined to his home or any particu-
lar place, but is required only to leave word where he may be
reached, the hours spent on such stand-by call are not working
time. Any such employee who is requested to be on call under
this section, on his normal day off, shall be compensated at
the rate of five dollars per eight-hour-shift. Such employee
actually called back to work during such on-call time :shall be
paid the stand-by rate and his hourly rate for one and one-half
times the hours worked computed to the nearest one-tenth of an
hour. All stand-by assignments must be made and authorized by
the department head.
(b) Fire Prevention employees
pay in the amount of twenty dollars
shall be entitled to stand-by
($20.00) for each holiday
where required to stand-by. Such employees required to stand-by
on week-ends shall be compensated at the rate of five dollars
($5.00) per eight-hour shift.
SECTION 4.
Sections 3.18.200(a), 3.18.200(g) (3) and 3.18.200(g) (6)
of the Municipal Code of the City of Bakersfield are amended to
read as follows:
(a) Policy. Sick leave shall not be considered as a right
which an employee may use at his discretion, but shall be allowed
only in case of necessity and actual sickness or disability.
Medical and dental appointments qualify for sick leave.
Sick leave shall be allowed in case the employee's
spouse or minor children are ill or injured and in need of medical
attention; provided, that they reside with the employee and no one
else is readily available to care for them.
Employees may utilize one eight-hour day or its shift
equivalent per year as personal necessity leave chargeable to sick
leave. Such leave is designed to permit employees time off during
normal working time to conduct personal business. Personal neces-
sity leave shall require prior approval of the department head and
shall be taken in minimum two (2)-hour increments.
(g) (3) One Hundred Twenty Days and Equivalent Shifts or Over
Unused Accumulated Sick Leave. All unused sick leave earned
during the calendar year over one hundred twenty days or equivalent
shifts accumulated will be converted into additional vacation time
at the following rates:
Management Unit, Blue Collar Unit, White Collar Unit,
Confidential Unit, General Employees Supervisory Unit, and Police
Supervisory Unit at seventy-five percent (75%) of the unused
balance.
Fire Unit, Fire Supervisory Unit and Police Unit employees
at fifty percent (50%) of the unused balance.
Effective January 1, 1981, Fire Unit and Fire Supervisory
Unit employees who do not use any sick leave for the entire calendar
year will receive one hundred percent (100%) of their unused sick
leave in pay as additional vacation. An employee who uses any
part of his sick leave during the calendar year will revert back
to fifty percent (50%) conversion of their unused sick leave.
(g) (6) When any member of the Management Unit, General
Employees Supervisory Unit, Police Supervisory Unit, Fire Unit and
Fire Supervisory Unit is absent from work due to an Off-the-job
illness or injury, sick leave credit shall first be deducted from
his current year's sick leave accumulation.
SECTION 5.
Section 3.18.220(f) of the Municipal Code of the City of
Bakersfield is amended to read as follows:
(f) Maternity--Leave of absence. Accumulated sick leave
may be used in cases of pregnancy, commencing with the date of
admittance to the hospital; provided, however, that should any
illness or condition arise necessitating medical care as a result of
such pregnancy or delivery, then in that event, additional days of
such accumulated sick leave may be used as may be necessary upon a
written statement of a physician certifying to the illness or
condition.
SECTION 6.
This ordinance to become effective thirty (30) days from
the date of its passage and to become operative on the thirtieth
day of June, 1980, upon the effective date.
