AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING CHAPTER 7.12 OF THE
MUNICIPAL CODE BY AMENDING SECTIONS 7.12.040(7),
7.12.100, AND SECTION 7.12.120(2) RELATIVE TO
FEES, DEFINITION OF BINGO, AND PROCEEDS.
BE IT ORDAINED by
as follows:
SECTION 1.
Section 7.12.040(7) is amended to read as follows:
7.12.040(7)
(a) The annual license fee shall be Fifty Dollars ($50). If
an application for a license is denied, one-half of the fee shall
be refunded to the applicant.
(b) An additional fee of one percent (1%) of the monthly
gross receipts over Five Thousand Dollars ($5,000) derived from
bingo games will be due and payable at the time the financial
report, pursuant to Section 7.12.220, is required.

SECTION 2.
Section 7.12.100 is amended to read as follows:
7.12.100 Definition of "Bingo." As used in this chapter,
"bingo" means a game of chance in which prizes are awarded on the
basis of designated numbers or symbols on a card which. conform to
numbers or symbols selected at random. "Bingo" shall include
cards having numbers or symbols which are concealed and preprinted
in a manner providing for distribution of prizes. The winning
cards shall not be known prior to the game by any person partici-
pating in the playing or operation of the bingo game. All such
pre-printed cards shall bear the legend "For sale or use only in
a bingo game authorized under California law and pursuant to this
ordinance."
SECTION 3.
Section 7.12.120(2) is amended to read as follows:
7.12.120(2) A portion of such proceeds, not to exceed ten
percent (10%) of the proceeds before the deduction for prizes, or
Five Hundred Dollars ($500) per month, whichever is less, may be
used for rental of property, overhead, including the purchase of
bingo equipment, and administrative expense. Such proceeds may
be used to pay license fees.
SECTION 4.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
