AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY
CHANGING THE LAND USE ZONING OF THOSE CERTAIN
PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED
ALONG THE SOUTHEAST SIDE OF THE STINE CANAL,
BETWEEN WILSON ROAD AND NEW $TINE ROAD.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission has held a public hearing on
a petition to change the land use zoning of those certain properties
in the City of Bakersfield, located along the southeast side of the
Stine Canal, between Wilson Road and New Stine Road; and
WHEREAS, the Planning Commission as a result. of said
hearing did make several general and specific findings of fact
which warranted a negative declaration of environmental impact
and a change of zoning of the subject property from R-1 to C-1-D
and C-O-D) and the Council has considered said findings and all
appear to be true and correct; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from the proposed project;
and
WHEREAS, the City Council has determined after due con-
sideration of said petition and the recommendations of the Plan-
ning Commission herein on file, together with the reasons advanced
at the hearings for a change of zoning of said properties that a
zoning change should be authorized; and
WHEREAS, the City Council has determined and found that
this zoning ordinance is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
1. All of the foregoing recitals are hereby found to
be true and correct.
2. An environmental assessment was made of the project
and a Negative Declaration was adopted by the Planning Commission
after a public hearing thereon and this Council hereby approves
the Negative Declaration.
3. Section 17.12.020 (Zoning Map) of the Municipal
Code of the City of Bakersfield, be and the same is hereby amended
by changing the land use zoning of certain property in said City,
the boundaries of which property are shown on the map hereto
attached and made a part hereof, as follows:
FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO A
C-1-D (LIMITED COMMERCIAL-ARCHITECTURAL)
DESIGN) ZONE AND TO A C-O-D (COMMERCIAL AND
PROFESSIONAL OFFICE-ARCHITECTURAL DESIGN) ZONE:
From an R-1 to a C-1-D
That portion of the Southeast Quarter of
Section 10 and the Southwest Quarter of
Section 11, Township 30 South, Range 27
East, M.D.B.&M., being more particularly
described as follows:
Beginning at the East Quarter corner of
Section 10, Township 30 South, Range 27
East;
Thence South 88053'20" East, 294.91 feet to
a point on the Easterly line of Parcel 3 of
Parcel Map 3426 as per map recorded April 26,
1976 in Map Book 15 at Page 157, Office of
the Kern County Recorder;
Thence South 31016'50" West, along said
Easterly line 52.06 feet to a point on the
Westerly line of Tract 3683 recorded March 28,
1974 in Map Book 25 at Page 107, Office of
the Kern County Recorder, said point also
being on the South right-of-way line of
Wilson Road and being the True Point of
Beginning;
Thence Southerly and Westerly along said
West line of Tract 3683 to a point on the
centerline of Treanna Avenue, said point
also being the Northwest corner of Tract 3680,
Unit D recorded September 16, 1976 in Map
Book 26 at Page 141, Office of the Kern
County Recorder;

Thence Southerly along the West line of
said Tract 3680, Unit D to a point on the
East right-of-way line of New Stine Road;
Thence Northwesterly along the East right-
of-way line of New Stine Road to the North-
west line of Parcel 2 of Parcel Map 3426
recorded April 26, 1976 in Map Book 15 at
Page 157 in the Office of the Kern County
Recorder;
Thence Northeasterly along said Northwest
line to the South right-of-way line of
Wilson Road;
Thence Easterly along said right-of-way
line to the True Point of Beginning.
EXCEPTING therefrom that portion which
lies South of the following described
line:
Beginning at the intersection of the East
right-of-way line of New Stine Road and
the Northwest line of Parcel 2 of said
Parcel Map 3426;
Thence South 85000'00" East to the West
right-of-way line of said Tract 3683.
From an R-1 to a C-O-D

Thence Northeasterly along said Northwest
line to the South right-of-way line of
Wilson Road;
Thence Easterly along said right-of-way
line to the True Point of Beginning.
EXCEPTING therefrom the right-of-way within
Treanna Court.
ALSO EXCEPTING therefrom that portion which
lies North of the following described line:
Beginning at the intersection of the East
right-of-way line of New Stine Road and the
Northwest line of Parcel 2 of said Parcel
Map 3426;
Thence South 85~00'00" East to the West
right-of-way line of said Tract 3683.
