AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 16.60.010
RELATIVE TO APPEALS TO THE CITY COUNCIL
AS A RESULT OF ACTION BY THE PLANNING
COMMISSION WITH RESPECT TO TENTATIVE
SUBDIVISION MAPS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That Section 16.60.010 of the Municipal Code of the City
of Bakersfield is amended to read as follows:
16.60.010 Appeal to City Council.
(a) The Subdivider or any interested person adversely affected
by a decision of the Planning Commission with respect to any tentative
map, may file an appeal from such decision to the City Council.
(b) Any such appeal shall be filed with the Clerk of the City
Council within ten days after the action of the Commission from
which the appeal is being taken.
(c) Upon the filing of an appeal, the City Clerk shall set
the matter for hearing upon notice to the subdivider, the Planning
Commission and affected interested persons. Such hearing shall be
held within thirty (30) days after the date of filing the appeal
unless the subdivider consents to a continuance. Within ten (10)
days following the conclusion of the hearing, the City Council
shall render its decision on the appeal.
(d) The City Council may sustain, modify, reject or overrule
any recommendation, finding or ruling of the Commission and may
make such findings as are not inconsistent with law.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30) days
from and after the date of its passage.
