HomeMy WebLinkAboutORD NO 2543ORDINANCE NO. 2543 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTH SIDE OF PLANZ ROAD, APPROXIMATELY 600 FEET WEST OF SOUTH CHESTER AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the north side of Planz Road, approximately 600 feet west of South Chester Avenue; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from C-2-D to R-2-D and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM A C-2-D (COMMERCIAL-ARCHITECTURAL DESIGN) ZONE TO AN R-2-D (LIMITED MULTIPLE FAMILY DWELL- ING-ARCHITECTURAL DESIGN) ZONE: All those portions of the Southeast Quarter of Section 7, Township 30 South, Range 28 East, Mount Diablo Meridian, City of Bakersfield, County of Kern, State of California, being more particularly described as follows: Thence North line, 185.13 Thence North line, 185.13 Thence North beginning of PARCEL 1: Beginning at a point on the West line of said Southeast Quarter, from which point the South Quarter corner of said Section bears South 00000'52" West, 669.53 feet; 00000'52" East, along the West feet; 89053'05" East, along said West feet; 89053'05" East, 2.04 feet to the a 420.00 foot radius tangent curve concave Northerly; Thence Easterly along said curve through a central angle of 7°19'36", an arc distance of 53.17 feet; Thence South 28022'00" East, parallel with the centerline of South Chester Avenue, 139.58 feet; Thence South 61°38'00" West, 138.60 feet to the Point of Beginning. Containing 14,785 square feet, more or less. PARCEL 2: All of Tract 4017, City of Bakersfield, County of Kern, State of California, as per map recorded April 16, 1979 in Map Book 29 at Page 1 in the Office of the Kern County Recorder.
