AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 17.52.060(d) OF
THE MUNICIPAL CODE RELATIVE TO NONCONFORMING
USES.
WHEREAS, certain structures which do not conform to zoning
restrictions cannot legally be utilized under existing zoning
ordinance restrictions; and
WHEREAS, under certain circumstances it would be desir-
able to the public convenience or welfare to allow utilization under
the previous nonconforming use; and
WHEREAS, the conditional use permit provides a means of
determining whether allowing the previous nonconforming use is
desirable for the public convenience and welfare and in harmony
with the objectives of the general plan.
NOW, THEREFORE,
of Bakersfield as follows:
BE IT ORDAINED by the Council
SECTION 1.
Section 17.52.060(d) of
Bakersfield is amended to read as
(d) Any part of a building,

such a nonconforming use, which use is discontinued or abandoned
for a period of one year or more, shall not again be used or occu-
pied for a nonconforming use unless such building or structure
cannot be utilized for any other use consistent with the more
restrictive zoning, in which event a conditional use permit may be
granted pursuant to Chapter 17.64. In no event shall a conditional
use permit be granted for a less restrictive use than the last
prior use of the building or structure.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30) days
from and after the date of its passage.

and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 12th day of December , 1979, by
