HomeMy WebLinkAboutORD NO 2534ORDINANCE NO. 2534 , NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING PORTIONS OF TITLE 13 INCLUDING CHAPTERS 13.01 AND 13.56 ADOPTING BY REFERENCE THE UNIFORM ELECTRICAL CODE, AND THE NATIONAL ELECTRICAL CODE, 1978 EDITION. follows: BE IT ORDAINED by the Council of the City of Bakersfield as SECTION 1. That Section 13.01.010 of Chapter 13.01 of Title 13 of the Municipal Code of the City of Bakersfield is hereby amended as follows: 13.01.010 Findings. The City Council does hereby expressly find and determine that the changes and modifications to the 1976 Editions of the Uniform Codes, and to the 1979 Edition of the Uniform Electri- cal Code and the 1978 Edition of the National Electrical Code, as adopted by reference by the ordinances codified in this Title pur- suant to Sections 17922, 17958 and 17958.5 of the Health and Safety Code, contained in this Title are reasonably necessary because of local conditions. SECTION 2. That Section 13.04.120(c) of Chapter 13.04 of Title 13 of the Municipal Code of the City of Bakersfield is hereby amended as follows: (c) That the Board of Building Appeals created herein shall serve in the place of and have the powers and duties of the Board of Appeals created by Section 204 of the Uniform Building Code, 1976 Edition; by Section 203 of the Uniform Mechanical Code, 1976 Edition; by Section 103(c) of the Uniform Sign Code, 1976 Edition; by Section 20.14 of the Uniform Plumbing Code, 1976 Edition; by Section 205 of the Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition and Section 204 of the Uniform Electrical Code, 1975 Edition. The Board of Building Appeals herein created shall also have respon- sibility of resolving any interpretations of the rules made by the Building Director, for resolving decisions made by the Building Director upon the approval of equipment and materials and for resolv- ing any questions concerning the granting of the special permission contemplated in a number of rules or suitability of alternate methods, in connection with the enforcement of the Uniform Electrical Code, 1979 Edition and the National Electrical Code, 1978 Edition. SECTION 3. That Chapter 13.56 of Title 13 of the Municipal Code of City of Bakersfield is hereby amended to read as follows: Chapter 13.56 ELECTRICAL CODE Sections: 13.56.010 13.56.020 13.56.025 13.56.030 13.56.040 Adoption of Uniform Electrical Code (Primary) and National Electrical Code (Secondary) Deletion of Certain Sections of the Uniform Electrical Code Amendment to Uniform Electrical Code Amendments to National Electrical Code, 1978 Edition Fee Schedule the 13.56.010 Adoption of Uniform Electrical Code (Primary) and National Electrical Code (Secondary). Except as herein otherwise provided, that certain primary electrical code known and designated as "Uniform Electrical Code," published by Pacific Coast Electrical Association, Inc., 1979, and that certain secondary electrical code known and designated as "National Electrical Code, 1978 Edition," published and sponsored by the National Fire Protection Association, three copies of both codes having heretofore been filed with the City Clerk of the City of Bakersfield, for use and examination by the public, are adopted as the Electrical Code of the City of Bakersfield, and each provision and portion thereof, except as otherwise in this Chapter provided, is referred to and made a part of this Chapter to the same effect as if fully set forth herein. 13.56.020 Deletion of Certain Sections of the Uniform Electrical Code. A. Sections 201(a), 204, 304, 311 and 312 of the Uniform Electrical Code are deleted and suspended by the applicable sections of Chapter 13.04 of the Municipal Code of the City of Bakersfield. B. Fees shall be as established in Section 13.56.040 of the Municipal Code of the City of Bakersfield. 13.56.025 Amendments to the Uniform Electrical Code. Sections 104(c), 302(d), 303(d), 308(a), are amended as follows: A. Section 104(c) is amended to read: (c) Existing Installations. Building electrical equip- ment and systems lawfully in existence at the time of the adoption of the 1978 National Electrical Code may have their use, maintenance, or repair continued if the use, maintenance, or repair is in accordance with the original design and no hazard to life, health, or property has been created by such building service equipment. B. Section 302(d) is amended to read: (d) Applicant. An application for an electrical permit may be filed (made) by anyone of the following: Qualified Installer: A qualified installer is a person, firm or corporation holding a valid Contractor's License to perform such work in this jurisdiction, or, Maintenance Electrician: In lieu of an individual permit for each installation or alteration, an annual permit may, upon application therefor, be issued to any person, firm or corporation regularly employing one or more electricians for installation and maintenance of electrical wiring, devices, appliances, apparatus or equipment on premises owned or occupied by the applicant for the permit. The application for such annual permit shall be made in writing to the Chief Electrical Inspector and shall contain a des- cription of the premises within which work is to be done under the permit. Within not more than fifteen (15) days following the end of each calendar month, the person, firm or corporation to which an annual permit is issued shall transmit to the Chief Electrical Inspector a report of all electrical work which has been done under the annual permit during the preceding month, or, Home Owner. The Chief Electrical Inspector may issue to an individual a home owner's permit authorizing said individual to install, alter, change or repair any electrical wiring, devices, appliances, apparatus or equipment in, on or about a single family dwelling of which said individual is owner and in which he resides or intends to reside, but not elsewhere; provided, that electrical work authorized under any such homeowner's permit shall be done personally by the owner. C. Section 303(d) is amended to read: (d) Expiration. Every permit issued by the Building Official under the provisions of the National Electri- cal Code shall expire by limitation and become null and void, if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced, a new permit shall be first obtained so to do, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided further that such suspension or abandonment has not exceeded one year. Any permittee holding an unexpired permit may apply for an extension of the time within which he may commence work under that permit when he is unable to commence work within the time required. D. Section 308(a) is amended to read: (a) The requirements of the 1978 Edition of the National Electrical Code (470 Atlantic Avenue, Boston, MA 02210) shall apply to all installations. 13.56.030 Amendments to National Electrical Code, 1978 Edition. The following sections are added or amended to the National Electrical Code, 1978 Edition: Articles 336-3 210-8(a) (1), 210-8(b), 230-56, 250-81, 300-13. A. Article 336-3 is amended to read: Uses permitted or not permitted. Type NM and NMC cables shall be permitted to be used in one and two family dwellings or multi-family dwellings not exceeding three floors above grade. For the purpose of this article, the first floor of a building shall be that floor designed for human habitation which is level with or above finished grade of exterior wall line of 50 percent or more of its perimeter. B. Article 210-8(a) (1) is amended to read: All 120 volt 15 and 20 ampere receptacles installed in bathrooms and garages of dwelling units, and in bathrooms of hotel rooms, motel rooms and similar occupancies shall have ground-fault circuit-interrupter protection for personnel. Exception: Ground fault circuit protection need not be provided on receptacle outlets located in a garage pro- vided such outlets are single and are intended for use with fixed or stationary appliances. C. Article 210-8(b) is amended to read: Construction sites: All 120 volt single phase 15 and 20 ampere receptacle outlets, which are not part of the permanent wiring of a completed building or structure, shall have ground-fault circuit-interrupters for per- sonnel protection. D. Section 230 article: 230-56 1. (Services) is amended by adding the following Special Residential Requirements In 1 and 2 family residences, a one-inch raceway shall be run from the service panel to accessible attics and crawl areas beneath floors for future use. 2. In residences, the service entrance conduit shall be rigid metallic conduit for overhead services. E. Article 250-81 is amended by adding the following sentence: On new construction, where concrete footings are placed, a grounding electrode complying with Article 250-81(c) shall be installed. Article 300-13 is amended by adding a new paragraph (c) as follows: (c) All grounding terminations shall be made-up, except for attachment to devices, prior to rough inspection. 13.56.040 Fee Schedule. A fee shall be paid to the Building Department at the time of application for each permit in accordance with the following schedule: 1. New Building or Structure. The following fees shall be applied to the nearest one-hundred square feet of building area. (Includes fee for service and temporary construction power.) Warehouses and shell-type buildings up to and including 5,000 square feet E. $ .0075 per square foot 1. That portion of warehouses and shell- type buildings in excess of 5,000 square feet 2. Storage garages and aircraft hangers where no repair work is being done 2. Alterations and Additions A. Where no structural work is being done or where it is impractical to use the square footage schedule. 1. Services and/or Sub-Panels a. Up to 600 volts $5.00 plus $1.00 per one-hundred amps or major fraction thereof b. Over 600 volts $15.00 plus $1.00 per one-hundred amps or major fraction thereof 2. Temporary Service Temporary or construction services including pole or pedestal (where no fee is paid, as in Item #1) Approval for temporary use of permanent commercial or industrial service equip- ment to facilitate testing prior to completion of the structure or final inspection 4. Blanket Work Permits A blanket work permit may be issued to allow a project to commence prior to the issuance of an itemized permit, when the total installa- tion requirements have not been determined. A full permit must be secured as soon as practical and within 30 days, for which full fees will be required. Blanket work permit fee $15.00 SECTION 4.
