HomeMy WebLinkAboutORD NO 2530ORDINANCE NO. 2530 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED O~ THE EAST SIDE OF CALIFORNIA AVENUE, BETWEEN MARELLA WAY AND BUSINESS CENTER DRIVE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the east side of California Avenue, between Marella Way and Business Center Drive; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from A to C-O~D and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result and WHEREAS, the City Council sideration of said petition and ning Commission herein on file, at the hearings for a change of from the proposed project; has determined after due con- the recommendations of the Plan- together with the reasons advanced zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: FROM AN "A" (AGRICULTURAL) ZONE TO A C-O-D (COMMERCIAL AND PROFESSIONAL OFFICE-ARCHI- TECTURAL DESIGN) ZONE: That portion of Section 34, Township 29 South, Range 27 East, M.D.M., in the City of Bakers- field, County of Kern, State of California, described as follows: Beginning at the intersection of the centerline of California Avenue with the centerline of Business Center Drive, as shown on Parcel Map 3933, as per map thereof filed January 25, 1977 in the Office of the Kern County Recorder in Book 17 of Parcel Maps, at Page 116; Thence along the centerline of California Avenue (1) North 00° 03' 57" W, 445.593 feet to the beginning of a tangent curve, concave Easterly, of radius of 2800 feet; Thence Northeasterly along said curve, through a central angle of 080 52' 57", an arc distance of 434.080 feet to the intersection of California Avenue with the centerline of Lennox Avenue; Thence (2) continuing Northeasterly along said curve, of radius of 2800 feet through a central angle of 18© 49' 59" an arc distance of 920.356 feet to the intersection of California Avenue with the centerline of La Mirada Drive; Thence (3) continuing Northeasterly along said curve, of radius of 2800 feet, through a central angle of 13° 43' 12", an arc distance of 670.485 feet; Thence (4) continuing Northeasterly along said curve, of radius of 2800 feet, through a central angle of 13° 43' 12", an arc distance of 670.485 feet to the intersection of the centerline of California Avenue with the centerline of Marella Way, as shown upon Parcel Map 2901, as per map thereof filed August 14, 1975 in the Office of the Kern County Recorder in Book 14 of Parcel Maps, at Page 38; Thence along the centerline of Marella Way, South 34° 54' 40" East, 574.733 feet; Thence South 29° 26' 49" West, 1,034.157 feet; Thence South 60© 33' 11" East, 19.045 feet; Thence South 27° 33' 46" West, 902.026 feet to the beginning of a tangent curve, concave Easterly, of radius of 994.613 feet; Thence Southerly along said curve, through a central angle of 27° 38' 26", an arc distance of 479.819 feet; Thence South 00© 04' 40" East, 101.789 feet, more or less, to a point on the centerline of said Business Center Drive; Thence along said centerline, South 89© 55' 20" West, 505 feet, more or less, to the intersection with the centerline of said California Avenue and the True Point of Beginning. EXCEPTING THEREFROM that portion thereof described as follows: Beginning at the intersection of the centerline of La Mirada Drive with the centerline of California Avenue as said Drive and Avenue are shown upon Parcel Map 4898, as per Map thereof filed March 14, 1979, in Book 22 of Parcel Maps at Page 98; Thence along the centerline of said La Mirada Drive and its Easterly extension thereof South 62° 21' 04" East, 424.00 feet; Thence North 27° 38' 56" East, Thence South 61° 00' 55" East, Thence South 29° 26' 49" West, Thence South 60° 33' 11" East, Thence South 27© 33' 46" West, Thence North 61° 41' 05" West 90.00 feet; 375.00 feet; 90.196 feet; 19.045 feet; 430.037 feet; 780.00 feet more or less to a point on the centerline of said California Avenue; Thence Northeasterly along the centerline of said California Avenue to the point of inter- section with the centerline of said La Mirada Drive and the True Point of Beginning. ALSO EXCEPTING THEREFROM that portion within street right-of-way. .......... o0o ..........
