AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 7.40.010(a)
AND 7.40.120 AND ADDING SECTlION 7.40.200
TO CHAPTER 7.40 OF THE MUNICIPAL CODE
RELATIVE TO PUBLIC DANCES AND DANCE HALLS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 7.40.010(a) of the Municipal Code of the City of
Bakersfield is hereby amended to read as follows:
7.40.010(a) "Public dance" for the purpose of this chapter
means dances to which the public generally may gain admission with
the payment of a fee but does not include dancing in a regularly
licensed establishment where dancing is incidental to the business
for which the license was issued and where the dancing does not
continue past 2 A.M.
SECTION 2.
Section 7.40.120 of the Municipal Code of the City of
Bakersfield is hereby amended to read as follows:
7.40.120 Closing Hours. All public dances and dancing in
establishments in which dancing is incidental to the business,
shall be stopped and discontinued and all public dan~e hails shall
be closed at 2 A.M. except when a special permit to continue
beyond such time has been granted by the Chief of Police.
SECTION 3.
Section 7.40.200 is hereby added to the Municipal Code of
the City of Bakersfield to read as follows:
7.40.200 Penalty For Violations. Any person, firm, association,
or corporation who violates, causes, permits or allows the violation
of any of the provisions of this chapter or who fails to comply
with any of the terms, requirements or provisions contained herein,
shall be guilty of a misdemeanor, and upon conviction thereof shall
be punishable by a fine not to exceed Five Hundred Dollars ($500),
or by imprisonment in the County Jail for a period not exceeding
one hundred eighty days (180), or by both such fine and imprison-
ment.
SECTION 4.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30) days
from and after the date of its passage.
