RESOLUTION NO.
A RESOLUTION OF THE CITY OF BAKERSFIELD
SUPPORTING STATE ASSEMBLY BILL 104 (SOLORIO)
CONCERNING ACCESS TO CRIMINAL RECORDS.

WHEREAS, current law requires local criminal justice agencies to supply local
criminal history information to specified law enforcement and other entities; and
WHEREAS, additionally, current law requires the Department of Justice to
maintain specified criminal history information and requires the Attomey General to
supply that information to specified law enforcement and other entities; and
WHEREAS, currently, city attorneys that are not prosecutors cannot get access
to that information; and
WHEREAS, Assemblymember Solorio has introduced Assembly Bill 104 (A.B.
104); and
WHEREAS, A.B. 104 will require the Attorney General and local criminal justice
agencies to supply criminal history information to city attorneys who are pursuing civil
injunctions and drug or gang abatement actions; and
WHEREAS, the Safe Neighborhoods and Community Relations Committee
supports the passage of A.B. 104 to assist the City Attorney's office in pursuing civil
injunctions and drug or gang abatement actions and recommends that the City Council
support the legislation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD AS FOLLOWS:
1. The above recitals are true and correct;
2. The City of Bakersfield supports adoption of State Assembly Bill 104
(Solorio) in order to assist the City Attorney's office in pursuing civil
injunctions and drug and gang abatement actions.
3. Staff is instructed to prepare a letter of support for Mayor's signature.
