HomeMy WebLinkAboutORD NO 2512ORDINANCE NO. 25]2 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED EASTERLY OF STINE ROAD, BETWEEN PLANZ ROAD AND WHITE LANE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, located easterly of Stine Road, between Planz Road and White Lane; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from A (Agricultural) Zone to R-1 (One Family Dwelling) and R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zones, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that consistent with the General Plan of the this zoning ordinance is City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: From an "A" (Agricultural) Zone to an R-1 (One Family Dwelling) Zone: All that portion of the Northwest quarter of Section 14, Township 30 South, Range 27 East, M.D.M., City of Bakersfield, being more particu- larly described as follows: Commencing at the northwest corner of said Section 14; said corner also being the centerline intersection of Stine Road and Planz Road; thence South 89°00'12" East, along the centerline of Planz Road and the North line of said Section 14, 2311.98 feet more or less to the Northwest corner of Tract 3761, Unit "A"; thence South 0036'09" West, along the West line of said Tract 3761, Unit "A", 220.00 feet to the True Point of Beginning; thence continuing along the West line of said Tract 3761, Unit "A" and "B", and Tract 3927, South 0036'09" West, 2198.08 feet; thence North 89002'07" West, parallel with White Lane, 850.65 feet, to the beginning of a 5770 foot radius tangent curve, concave to the North; thence Westerly along said curve and parallel. with said White Lane through a central angle of 6°12'55" an arc distance of 625.91 feet; thence North 82°49'12" West, parallel with said White Lane, 384.17 feet, more or less, to a point on the centerline of the Kern Delta Water District Canal; thence 288.71 thence thence thence thence feet; thence thence thence thence thence North 10°36'12" West, along said centerline, feet; South 89023'36" East 230.00 feet; South 64015'52" East 95.82 feet; South 89023'36" East, 137.00 feet; at right angles, North 0036'24" East, 750.00 South 89°01'10" East, 307.00 feet; North 7°16'00" West, 280.19 feet; North 0036'24" East, 586.00 feet; South 89°00'12" East, 150.00 feet; North 3029'44" East, 265.26 feet; o thence South 89°00'12" East, parallel with planz Road 1027.00 feet, more or less to a point on the West line of said Tract 3761, Unit "A", and the True Point of Beginning.
