HomeMy WebLinkAboutORD NO 2511ORDINANCE NO. ___ 2511 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SUBSECTIONS (c) AND (d) OF SECTION 17.58.030, OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, BY PROVIDING FOR AN ANNUAL PARKING PAYMENT FOR CHANGE IN USE FOR SO LONG AS SUCH USE CONTINUES. WHEREAS, the City of Bakersfield desires to encourage the use of existing buildings in the downtown area; and WHEREAS, some businesses are reluctant to enter into a 20-year agreement with the City for the payment of in-lieu parking fees; and WHEREAS, the objective of Ordinance 2450, New Series, can be accomplished for buildings with a change in use by providing for the payment of an annual in-lieu parking fee for so long as the use continues to a maximum of 20 years. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That subsections SECTION 1. (c) and (d) of Section 17.58.030 of the Municipal Code of the City of Bakersfield are amended to read as follows: 17.58.030 (c) The in-lieu parking fees to be paid to the City of Bakersfield for change in use shall be in the amount of $350 per year for each additional required parking space in the core area and $250 per year for each additional required parking space in the extended area for so long as such use continues, but no longer than 20 years. For new or moved structures, the in-lieu parking fees to be paid to the City of Bakersfield shall be in the amount of $7,000 for each required parking space in the core area and $5,000 for each required parking space in the extended area. The Planning Director may authorize equal annual payments of in-lieu parking fees, with interest at 10% for any period up to 20 years. In determining whether annual payments may be made and the period of such payments, the Planning Director shall consider the criteria contained in Section 17.58.030(6). An aggrieved applicant may appeal the decision of the Planning Director as provided in Section 17.58.030(6). (d) In-lieu parking fees paid annually shall be due and payable on the 10th day of January of each calendar year pursuant to an agreement executed by the applicant and the Planning Director on behalf of the City of Bakersfield. Failure to make the annual payment will forfeit any payments made by the applicant for in-lieu parking fees or the applicant's successor and will require the applicant or the appli- cant's successor to comply with the parking provisions of Chapter 17.56. The agreement establishing the in-lieu parking fee for new or moved structures shall be recorded as a covenant running with the land. SECTION 2. This ordinance shall be posted in accordance with the City Charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... 000 ..........
